    If there is no crime, there can be no fine.

    There has to be a breach before the fine is issued, it is up to the individual whether they commit that breach.

    It's a bit like saying that fines for shoplifting, drunk and disorderly etc are a problem.

    The other alternative is that we are quite happy with the present system of motorists being fined for speeding, yellow box offences etc where it is a simple clear cut and unequivocal cause - failed to obey the law.

    Are you not familiar with the phrase "otherwise law abiding motorist"? You can find it in the Daily Mail, the Daily Telegraph and, oh, nearly forgot, sprinkled liberally all over that repository of normal, sensible, well balanced human beings, the SS forum.

    It's such a shame when an otherwise law abiding motorist breaks the law and is punished. It's a great phrase. We should use it in other places too. "otherwise law abiding rapist" would be a good start.

    When and where did this happen, why did it happen?

    The article is incomplete, biased and has an axe to grind.

    Quite often the "silly arrests" are simply a way to get an offender "onto the list" for a series of minor offences. Had this individual already got a record, was it just a slice of cucumber, or had he been previously seen ditching a whole picnic elsewhere and this was the observed incident?

    Can you shed light on the way you came to your assumption?

    There is always going to be some form of bias, you simply have to make that acceptable.....

    The trick is to ensure that the bias is structured correctly.

    If the evidence is there that a crime has been committed, how is it biased to prosecute the individual who has chosen to perpetrate the crime?

    Do you have an alternative suggestion as to how we can maintain the same level of detection for speeding and other offences symptomatic of poor driving, and expand the "Traffic Police"?

    I see nothing acceptable about hypothecating revenue in our criminal justice system. The idea is abhorrent and would undoubtedly lead to corruption.

    I have no interest in detection for speeding offences. I do however have a great deal of interest in detection for poor or dangerous driving, and illegal driving.

    There were plenty of Traffic Police beforehand - I see no reason why the money can't be found to re-employ them. Its not as thought the government is short of tax revenue.

    If that is the case than they should be charged with careless or dangerous driving.

    I should tell you that on my advanced driving exam, I did not adhere to the speed limit. In fact I broke it many times, yet still passed because my driving was to an acceptable standard. The examiner was a retired police advanced driver and mentioned the speed limit only in passing, and without any critisism.

    Interestingly the IAM position is that they would withdraw their endorsement of your examiner who allows speeding during an exam. If there is any proof of your claims, then it would in fact invalidate your qualification.

    But back to the point.......
    This illustrates that the crime one is prosecuted for is the one that is proven, not necessarily the one the Police would like to proceed with.

    Oh I disagree Tony. They don't usually argue the SS mantra and deny the link. I don't know what cretin's plan was, but it failed from the off, when he refused to answer the question about his link to the SS.
