Just received a confusing E-Mail from Wiggle (depending if your cup is half full or half empty) stating that I will be refunded my money as they could not process my order. The 2nd sentence suggests that they will dispatch in 2-7 days.
Will they or won't they?
Should I have tried to buy two pairs???0 -

If they have actually taken your money then they have formed a binding contract to supply the goods (I believe). Unless they are physically unable to supply then I think you would be within your rights to insist they do.0 -
I had the same email about a back order with a different order number and then that back order now shows as being cancelled !
I seem to recall that errors and omissions can be a reason for online sales to be cancelled by the vendor but don’t quote me.
Serves me right for shouting about it.

The way I read the email though suggests they will honour it on the back order when they get stock. I have just emailed them and asked them to confirm because I have shaken hands on a deal to sell the Aksiums coming on my new bike to someone I work with. I don't think thats the case, at least I bought a Garmin 810 bundle off an amazon seller for a cracking price, unfortunately it was an error, Amazon had already taken my money and I received an email from the seller 3 days after making the order saying it was an error and that I would receive a refund. Nothing I could do.0 -

I dont know how it works with a marketplace seller as Amazon is just an agent and although they may have taken the money, they may not have given it to the seller yet.
But in general ecommerce rules, an item on a website and even an order for that item and acknowledgment of that order is just an 'invitation to treat' and not legally binding. No contract exists until they have taken your money, at that time the deal is formalised and legally binding and a contract to supply the goods exists. It may even be possible that they would be forced to get stock by any means if you pushed them to the law - even if that meant buying from another retailer if the distributor has no stock.
This is one of the key reasons why they dont normally take your money until they ship - not for your benefit but to protect themselves...0 -
