to confirm that the bike was advertised with a link to the nealpryde website which confirmed the bike had a full da groupset, including cassette. Firstly the seller claimed it came with a 105 cassette, then later changed his story to 'I changed the cassette to improve the bike@. The cassette was returned, not recorded, but proof of postage, session id 1-893932 on 18/2/13 at 16.57. The proof of postage covers refunds up to about £40. Now the seller claims that the post arrives in a communal box, here is the email "There is a communal mail box for both offices and apartments and the mail is sorted daily.
I expect you to return the correct cassette. I rather doubt you will though. I think most people on the forum are realising that now.
Not a problem for me Berni. I believe in karma. ".
I had asked him for an original proof of purchase to help the claim which he has refused.
He has lied, I have no evidence that he does not have the cassette and I have proof of postage. Seems odd that it has gone missing or is that another lie from the seller? I will email him a scan of the postage proof. He is also claiming now that the 105 , hardly used cassette has transformed into a new cassette!0 -
I'd calm down if I was you. Your statements may well be libelous.0
-
so now he stole his own cassette?
I think the mods need to rename this thread to Michael Pinchen feeling ripped off.0 -
no paul mck, just seems odd that I have sent about 100 parcels over the last couple of months and it's the only one thjat's gone missing.
Anyway, I have offered him the price of a new cassette on ebay .0 -
I'm read the whole thread now. Holy crap, what a waste of oxygen. Here is my 2p's as to how I would have reacted on noticing it was 105 not DA
1) Shrugged, and gone out for a ride
2) Email seller, asking to confirm, maybe having a light moan
3) Gone out for another ride
4) Cross out 105 and write Dura Ace on the cassette, in permanent marker.
I get "ripped off" quite a lot, because frankly life is just to short to rush around suing everyone. The other day I ordered a merino wool top, size 38 chest, but when it came it was more like 37.5. I feel cheated. But hey, that's just me.Insert bike here:0 -
But if you bought a Dura Ace cassette on ebay and a 105 turned up, what would you do? New, a Dura Ace is typically £100 more.0

i accept that and have said that the OP is perfectly within his rights to do what he's done - all be ait a bit over dramatically imo. but does it really make that much of a difference to your everyday rider?
as i said before i wouldn't care if i bought an xt group and the guy had said i've put on a newer slx one for you.
but hey ho, life would be boring if everyone was the same0 -

not comparable at all. if youre buying a cassette then you would expect it to be what it says it is. Passing off a 105 cassette as a DA one is 100% incorrect.
In this case its one component that was wrong. Which is what? 5% of the bike as a whole? Everything else seems to have been exactly as described. And its not uncommon for bikes to be advertised as a full XYZ groupset then have a lower spec cassette. ie Dolan.
So you gotta compare apples to apples.0 -
Either way, it is still a significant, expensive component, which the OP has every right to expect given the advert, and every right to pursue given the value. You are entitled to the proper description: not many bikes are advertised with 'full' groupsets anyway and, if they are not full, then they are leaving themselves very open to recourse.
I personally would follow it up and get what I had paid for or expect compensation. This is why the classifieds rules asks for a full spec. The OP made a mistake and (as it seems he is), rectify it.0 -
i now have the correct cassette and have sent the seller the price of a new 105 cassette on ebay, think supersonic makes good points. I dug my heels in after the sellers comments " it came with a 105 cassette"" to " I changed the dura ace to a 105 to improve it". Just felt he wasn't being straight with me. Think this thread may well be done now!0

Seems like a good resolution! Despite a few crossed wires and postal problems, all is good.
However I will change the title of the thread.0 -

Berni glad to see that your are there & can get out and enjoy your new bike. As per a previous post I made I too saw the for sale & thought that it was a nice one, hope you enjoy it & we have some good enough weather for you to get out on it.Pain hurts much less if its topped off with beating your mates to top of a climb.0 -
Aaah but, before we all trot off into the sun set, has anybody (particularly the 2 principle characters) learned anything from this debacle?0

pay using paypal next time!0

I learnt to follow my instincts They were telling me to walk away even before Berni had committed to buying. I should have listened.0
