I'd recommend getting legal advice - if you're a BC member call their incident hotline (if you've not already done so).
Check "Fill that hole" http://www.fillthathole.org.uk/ to see if the road defect had been reported previously. Find out the council or borough who are responsible for the maintenance of the road and request, via FOI, their inspection regimen over the last couple of years.
If the road is residential and Keyser fancies a ride down there, he could knock on a few doors in the vicinity to try and ascertain how long the pothole had been in situ. Furthermore, photographs of the pothole with a ruler for scale would be good. That said, if you've already reported it, they might have repaired it by now.

The general principle with chasing these (if you end up having to do it through the county courts) is that you have to demonstrate that the council have not abided by their own standards for road maintenance. It's generally accepted that it is impossible to keep all roads pothole-free all the time, so what you need are the details of the procedures the council follow for monitoring and scheduling repairs (which they should provide to you) and then use that to scrutinise the actual logs of damage to the roadway from council inspections (which can be obtained via FOI request).
Usually, councils have a schedule for inspections and a grading system for classifying damage, which is used to allocate resources such that the most dangerous stuff is dealt with quickly. Usually there will be specified timescales when things should be done (i.e. "grade 2B hole should be repaired within five days", etc). What you're looking for is one or more of the following:
-evidence that the road has not been inspected when it should have been
-evidence that the pothole has been there a while but does not appear in the inspection logs
-evidence that the pothole is in the logs but its severity is not correctly recorded (going by the council's standard, again)
-evidence that the pothole was correctly logged but that rectification work was not carried out within the timescales specified in the council's processes
-evidence that the council were made aware of the pothole but did not act on that information (fillthathole is good for this)
I've done quite a few of these (I work for a motor insurer, if you break an alloy in a pothole we'll try to get the cost of repair back off the council responsible) and it can be done, but it is frequently a tremendous faff. Probably worth a few letters and some poring over iffy photocopies of maintenance logs for a Zipp 404, though.0 -
