    Oh I was aware that he came straight out of the side road..

    But was not expecting a shunt in the rear.

    Might claim will talk to sols tomorrow, everything is aching, but deff want my baby fixed or replaced.

    They either repaint and serivce my forks, new ritchey carbon bars and seatpost and rear wheel, or they just give me 3000.00 for a new zesty or something.

    But the bike and I are sole mates, would hate to see it go, but like people said you never know, something goes out of place by a mm or 2 and thats it.

    Its a Focus superbud 2008, its a damn nice looking bike, even the copper was drooling and he has a boardman and a orange.

    If it's any consolation when I was knocked off in a similiar fashion(all be it a"sorry didn't see you, mate,situation). I took said numpty,blinda*s,doddering old giffer to court and got a replacement ride no questions asked, bought the ruin back off the insurance company for £15 and sued his backside and got just under £4,000.

    One good thing came out of it though.....will never go out without a helmet on now!!!!

    I would defo be putting a personal injury claim in - find a set of the no win no fee leeches and let them sort it out.

    As for your bike - it's only a thing. I know it's precious but it's easily replaced. You aren't. You're (relatively) OK and the bits that aren't will heal. Nice hot bath, few tinnies and crack on...

    If it were me I'd want a new bike, you never know how it's been stressed especially as its been hit from behind, I doubt the designers ever built that into the equation!
    Dont forget to mention the flashbacks and nightmares to the solicitor, mental trauma can be a serious thing :wink:

    Yes dude, I am making all this up, I made up a 93 year old MBE who drives a BMW and hit me in the rear, and on top of that made up a fake groin injury and elbow injury.

    And on top of that, my new samsung phone is scratched and my Ralph loren jacket from NY is wrecked as well.

    Why the hell would I make up any of this, just so people could say get well to me.

    I could lay all this on, but as I work for insurance it would not look good if I was faking, I think my bike and elbow and groin are enough.

    But saying that, I have no urge to watch internet porn right now, :lol:

    It was good to hear the police taking it seriously (and a keen cyclist too!)

  • I sort of know how you feel as I was involved in a RTA last year when a driver forced me off the road. Do not remember anything of it, not even the 3 day hospital visit.

    Been told by my parents there is nothing worse than having the police knocking on the door and saying you need to go to the hospital now. Parents saw me in the A&E in a right state mainly due to the touch and go nature. Resussed at seen and if not for the helmet I have been told I would not be here now.

    Insurance claim currently still going through the process and its been nearly a year now as in my case I needed to have various medical reports done. Driver was arrested and bailed to appear in court. He actually had to go on a better driving course which cost him £180 ish and informed that the incident will go on record and if involved in a similar accident within 3 yeras would be used as evidence.

    when you say forced off the road do you mean he did it on purpose? cos if he did it doesn't seem like he got much of a punishment!

    i had a driving instructor when i was learning who used to always say 'remember, in effect you are driving a lethal weapon'

    That really stuck with me and it is how the courts should be viewing it too.
  • Canada, get well soon mate. This is a terrible example of how dangerous a threat some elderly drivers can be, assuming it was unintentional. If it WAS intentional, it would not surprise me, if he had some personal issues with young people cycling, all be it perfectly legally.

    Dave is right, your welfare comes before the bike... all the best.

  • Glad you're okay. Got hit myself last year by an old lady. I was ready to settle for the cost of repairs to the bike, but my solicitor insisted I get a new one and a nice compensation cheque for my trouble. As a racing cyclist himself, he dealt with it amazingly quickly, got me more than I could have hoped for, and even extra for a new bike, even though I got the hit one repaired for £100!! I felt bad at first, but how much is your life worth, not much to him!!

    If you want his number PM me, drivers like that need to pay and with a bit of luck his premiums might keep him off the road before he does anymore damage!!

    I was going through one of the 'raffic calming' measures the ones that have isalnds at the side of the road to force you to go one side then the other. This particular one is around 200yds long with car parking one 1side for a 1/3 then the other side for about a 1/3 and the last bit is free.

    I was going down the hill and just starting to enter the last 1/3 of parked cars as, from what I am told, he hqad reached the transition point. Being a van I took avaoiding action, clipped the kerb which took the front wheel out and I smashed my head against the concrete wall.

    I do not feel that its much of a punishment but his insurance hike might help.

    A word of advice here. Before I worked in IT I used to be a injury claim handler for a large insurer so don't lay it on too thick. If they think you are, then they will send the case out to a fraud unit who will go through everything with a fine tooth comb anything slightly dodgy and they will chuck the whole claim out. Luckily it doesn't sound like you were too badly hurt but you should get a nice lump of cash if you're just honest and play it straight. I chucked out loads of claims becuase people took the piss, like a blacksmith who claimed he couldn't work and was claiming for 2 years loss of earnings...until we got him on video carrying an anvil :lol: (No not Supers Zaskar ;) )

    I haven't read the details, but I would pursue a claim for the damages and personal injury through his insurance. Don't rely on the police criminal prosecution to compensate you. there are plenty of no win no fee personal injury lawyers around. they will love this one.

    Were you wearing a helmet, high vis, lights etc..? Also when you talk to your lawyer make sure you make the point that it was a deliberate attack. As this will likely be used in any contributory negligence angle if such an angle is raised.

    just one thing though, i looked through my british cycling book thing, and members get legal cover for an accident. notice the picture is of a car hitting the cyclist up the arse!

    I work in claims and deal with outbounding T/P's and speak to police and have knowledge of fraud. I am not laying anything on, as I know how easy it is to get caught.

    Why do you think whiplash only get 1000 to 1800 its becasue the most put it on and dont have the real symptoms.

    I have had a headache all day, and my elbow does hurt and my groin, and thats what I am claiming for. Oh and my bike and Kit.

    I wont be making a fake claim as I would lose my job, if caught and I love my job.

    If I was you I would be off to the quack to get your back looked at. This also documents your injurys
    I had an accident a few years ago when i got a 5 meter swinging pole barrier in a garage forecourt came through the front of my transit and trapped me against the side door so i couldn't escape. How I walked away only God knows. I was stiff as a board for a few days and had to go to the quack to get a prescription for pain killers.
    The Garage wouldn't admit responsability after the owner told me he would, so i had to pay for a replacment van myself as my van was a write off. So at this stage I decided if this arse is going to tell lies and deny me the write to a living I am going to make a claim against him.
    My back gradually got worse and worse and was bad for years later and I had to have physio and oesteopath treatment for months at my expense. Eventually MY insurance payed for me to have a MRI scan where they found the accident had squashed my vertebra and was trapping nerves in my back which was sending pain into my groin area and causing numbness in my butt and legs. I was self employed cabinet maker and couldn't lift bugger all. Then 4 1/2 years later my back gave way completely. I won't bore you with the rest.

    BUT IF YOU WANT SOME SOUND ADVICE TAKE HIM TO THE "KIN CLEANERS"!!!!

    you might feel ok now but things like this have a habbit of coming back to haunt you.

    Keep a diary of everything, Injurys, time off work, items broken or lost ,prescriptions journeys to doc physio etc etc. 6 years after my accident I am still in pain no amount of money can ever replace your health. (But it can help a bit).Remember you did nothing wrong and this Tw@ tried to hurt you and more importantly your bike. Being as he is 93
    I would get your claim in quick he might not be here long!

    P.S I know a good solicitor :wink:
