    Get well soon!! When you feel up to it and know more contact someone like RJW (the CTC's solicitors) to deal with all the pain of replacing the damaged parts, etc.

    It's seriously not funny when you get hit at speed.......been there, but to not know - from behind ? .....sheet..............and waking up in hospital..........crikey.....

    That must have been some shunt...... glad you are in one piece........

    I remember every milli second of the car hitting me at 30 from the side, even thinking 'oh glad I've got a helmet on...as the sound of the helmet scuffed along the tarmac......... the pain doesn't hit till you try to get off the road............

    Do let us know how the bike is........and you ! (sorry Mrs it's the bike law - bike check first........... ) :shock:

    What OSK said - are there any shops or houses nearby whose occupants may have witnessed anything? You could knock on their door Any CCTV cameras? This assumes that the police have no evidence which assists you yet.

    Rich's injuries look quite similar to my friend's who came off over the handlebars of her bike :(

    Got my bike back this morning, it's kinda in one piece except for the front wheel, which is totalled. Evidently the idiot in the people carries tuned right across my path and I ran straight into the side of him at abour 25mph :shock: :shock: :shock:

    Although the frame looks intact I guess such an impact will leave it totalled, but at least there's the makings of a claim, and it looks like the other guy was insured :lol::lol::lol::lol::lol::lol:

    Now it's time to choose a new frame :wink:

    Glad we now know that the police have the details of the other driver. Kudos on feeling recovered enough (or on sufficient meds) to want to go bike shopping!

    I got hit i little while back, Jon Lear at BIKELINE (alyson france) solicitors dealt with my claim, they are really good. Get a decent LBS to do an assesment of the damage and you'll be sorted bie wise.

    Didn't deal with Jon but did use the services of Alyson France when I got KO'd my bike. Excellent firm, the only thing they couldn't help with was the time it took to settle the claim. One year from accident to the cheque hitting my bank account.
    I've added a signature to prove it is still possible.

    I wonder if there is a people carrier driving around out there with your face print moulded in to the side of it?

    p.s. got knocked off in Italy last Thursday, luckily just a lot of grazes to me and some to the bike. You win :wink:

    I've just had a letter from Kent police informing me nobody will be prosecuted over my incident. Given that the diagram they showed me had the people carrier turning right across 3 carriageways into my path I find this unbelievable. Evidently it's now fine to turn right against the flow of traffic, knock a cyclist into next, leaving him with multiple lacerations, a possible dislocated shoulder, amnesia, missing teeth and potential long term shoulder problems.

    What about my right to ride along a road without being knocked senseless :shock: :shock: :shock: fecking wankers, if it was another car he'd hit I bet the arsehole would have been prosecuted

    That's it. my ire is vented, for now, just don't ask me about this again.

    evidently it's fine according to Kent police. The sun was in the motorists eyes and he coudn't see anything :shock: which meant he was able to pull across the traffic with immunity from prosecution :twisted: :twisted: :twisted: :twisted:

    Honestly it beggars belief, a complaint has been made to Kent police

    If you feel so strongly, why not start a private prosecution? I am always depressed when its deemed ok to drive when you can't see where you are going.

    Have the police told you why they are not going to prosecute? Assuming it is a careless driving matter then decision would be made by police not the CPS.

    Make a complaint to the police about the decision [just read you have done that!]

    indeed doesn't sound in any shape reasonble action to do, i do wounder about being blinded by sun, as many years ago I was involed in a 3 car crash, sun was behind us yet that was given as the reason the first car crashed into the van that was shunted into my car, as I was waiting to turn right.

    Since my car was a heavy swedish iron, it was just some paint marks on the bumper. but the van in the middle was wrecked.

    Might be worth taking some legal advice, and check what postion the sun was in, in my case the "sun in my eyes" was a sop since it was behind her.
  • I seem to recall you mentioning it was Station Road in Southfleet? I don't know which junction you are talking about along there, but presumably you were coming from the Bean direction? Most of that road has high hedges and is undulating enough for the sun to be behind a hill usually before it gets so low as to be in your eyes. I can't see how the sun would be in her eyes? Even if that were an acceptable excuse in the first place!

    If it is not too traumatic, it might be worth going back there at a similar time over the next couple of days. The sun will not be in exactly the same position, but it may give an idea.

    +1 to the idea that it is OK to proceed when you know you can't see properly (or when you are blinded) being crazy. Would the Police/CPS decide not to prosecute if she had had a blindfold on?

    You may not want to be hassled by the following; you've been through a no doubt harrowing experience, not helped by this decision. But might it be worth contacting the CTC on the campaigning side? Was it them who were taking up a similar refusal to prosecute following a death where the driver said they didn't see the cyclist? They might be building up a dossier of similar cases?

  • Just catching up after hols, but glad you're relatively OK after that Rich. Can't believe how useless the police are. Road rash of the year award looks like its in the bag. :(
