    The actual response is like this, we dont know how deep the pothole was, so we cant make you valid the guarantee, it is your fault for bad driving, something like that.


    Well the frame shouldn't crack - if the wheel is undamaged then the impact couldn't have been out of the ordinary.

    What shop was it? Consumer Rights Act puts the onus on the seller to prove there wasnt a fault when you bought it if within 6 months. If it is within 6 months take it back with a letter rejecting the bike as faulty - mention the consumer rights act - if they still wont play ball try BMC importers or court I suppose?

  • If over 6 months dont give up but the onus is on you to provide expert opinion it was faulty when bought. All this is independent of any manufacturers warranty.

  • Well, I ve been mailing them and nobody answers, I have all the images and still afther 3 weeks my wheel has the same pressuare as before the crash. I Will puta the image of the pothole, I am 1,82cm taller and 82kg aprox. Consider that I was going less than 30kmh as before the pothole is a roundabout with los of traffic (if you want do a research of the traffic in Lima, Peru). Also I was trying to go right to Take the right late but a bus dont let me to do so(here People just dont care about you), so after the bus pass I Take the right lane behind him and the pothole appears I go over it, dont fall, dont get a puncture but get a crack on my trusty bike.
    Sorry for the english if it is too bad. Again, Consider the worst traffic in london is the lightest kind of traffic here, so it is imposible to go to fast!

    as far as pot holes go, it is big but looks quite smooth, almost like a ramp into and out of it, i don't see how that would cause that damage (not doubting you just can't work it out)

    Looks like user error to me. Knowing how stiff those frames are it must have. Been one hell of an impact.

    Reckon they would have been more inclined to believe you if you had actually damaged the wheel. Can't really understand how you would have had such a huge impact yet not even burst your tyre.
    I'm not doubting your story but I think you're going to have a job convincing bmc to help you out with this.

    Yes, its one hell of an impact that doesn't look like it was done by hitting a pot hole

    I think the best outcome the OP will be able to get is to purchase a discounted new frame under BMCs crash replacement scheme, assuming you registered it with BMC.
