Agree with Spen - there is no third party - the damages are from the MIB. No need to repay Private Insurance

I think the MIB is a third party, the point is OP is not recovering his physio's fees from them therefore there is no double recovery (which is what the medical insurers are concerned about). I would hope he'd be OK on this, given that the MIB has been clear about what the offer covers and what it does not.
