Sorry to read of your problem
You have clearly been wronged but I suggest you reduce your anguish and either build the bike and ride it or sell the frame on, hopefully not for a loss and move on
I use Ebay a lot and have been lucky to deal with honest buyers and sellers but sadly there is always that chance of being duped.

Just because it was made in 2008 doesn't mean it isn't a 2010 model. The item doesn't have to be made in the year it is sold in and seldom is. If there have been no changes to the design or colour scheme and it hasn't been used then its as good as one made in 2009 which is when a 2010 is more likely to have been made. If the seller was trying to rip you off he would have removed the sticker.Pegoretti

So you're going the route that the seller didn't lie, he just didn't tell the whole truth? That's weak.
The description should have listed it was made in 2008, as that's what the sticker CLEARLY states. The description should have stated something to the effect of
" this item was manufactured in 2008, but no changes have been made from 2008, to the current model, therefore it's the same as a 2010."
It would then fall on the buyer to confirm that statement.

Never again for me unless I can view the goods and collect them in person before handing over any money.
