Yup the Five should have a 190 E2E shock with a 50mm stroke. (may be a few mm more showing on the shock shaft)
As Nick says the BB centre height should be 6mm higher than the rear axle centre

Can you get a picture of the swing arm to seat tube clearance? Looking at the picture you posted it does not look like there is much more clearance between the two?0

In that picture you posted there does not look IMHO to be that much difference in the measurement. If i line the rear QR and crank center with the bottom of the screen. Taking into account that the pic is probably not level but still it does no where near look like a 40mm difference imho.0 -

It does seem that your shock is not quite right though.
I've had one stick down before now. You can fix it a thome quite easily. Just release all of the pressure and carefully remove the air can, watch it though, as it will force itself off. Then clean the seals (replace them is preferable) and reassemble it. It fixed my old Fox Flloat Triad a few years back.0 -

MFC - my measurements are not like that at all so it does look to be a shock fault
