...just been knocked over...

Hi there

I was commuting back home today, in Stoke Newington High Street.
When a car decided to change lane without even looking, in my defence I shouted at him but he didn't stop, he hit me on my left side and knocked me over, While I was on the floor, he tried to go past between me and the cars on the lane that he was in before, to try and run off , luckily three ladies managed to stop him, thanks for that, then when he directed himself to me and said: "Sorry sorry, I'll pay everything but don't call the police". And I was left thinking why??? The police found out he had no licence, the ladies called the ambulance and the police. Then when I started giving my details to the police, a female officer, very kind, she was kept on calling my bike a "machine" , when I asked her why, she said that she is a racer herself and "this guy is going to get done, really done for this", she even gave me her phone number to know how the process goes, thank you Sue.

In the end, my bike got lots of damage such as: brake levers, handbar, my carbon forks, my seat and the worst the frame.

I was a mile from home so my wife came to pick me up.

I'm full of bruises, on my hip , my knee and my left arm its very badly, my hands also.

Then my jersey ripped, my shorts, the helmet, my glasses, even my cateye computer screen broke.

I'll let you guys know what's going to happen after.



Also one of my friends just called me now, and said that he's at the scene and the car is being taken away by the police.

    Blimey, sounds like carnage. At least there'll probably be a good resolution. Also good to hear the bystanders stopping the '...and run' bit of the story.

    even if the ladies hadn't called the police, the ambulance service would have done as it is standard practice at an RTC reported to any service.

    feck me people like that shoukd have their licenses taken away again and never ever be allowed to drive.

    Get well soon and get yourself a blingy new one if you can find some insurance to claim off ???

    Reading the OP there was no license, and therefore no insurance.

    Terrible.... Just so many people on the road that should not be there. Hope he goes to jail, even for a short while, might make him think next time.

    I hope the bruises heal soon mate, and you're back out again.

    You need to contact the MIB as they will square the cost of the damages caused by an uninsured driver - at least this way you won't end up out of pocket

    Jeebus. I hope this bad streak doesn't come in 3's :(

    Never heard of the MIB before (other than in the films). That's something worth remembering for future (though I hope I won't need it).

    Hope you manage to get your bike sorted and I hope this driver is bought to justice.

    Claim from the MIB - it was set up to deal with the victims of uninsured drivers or untraced drivers. Remember to get correct claim form as they are different for the 2.

    Get well soon mate and good luck getting what's owed to you from the numpty (more likely the MIB as stated above). Seemed to be national carp driving day today, was cut up about 4 times in 7 miles, in each case if I'd been 5% less focused on what was going on I would have been knocked off. Also saw a Connaught delivery truck deliberately swerve towards a roadie on the stretch from Oval to Kennington (the suicide bike lane bit), got a bit heated at the lights as a few people politely pointed out that his actions had been noted, at least one was calling 999 with his number plate.

    Sorry to hear about your accident, hope you're healing up ok.

    I got run over by some moron not looking where he was going last year. Luckily for me he was insured so I'm suing him for my bike and my ruptured knee ligaments!

    Your situation sounds more complicated due to the no license/insurance problem, I suppose you can still sue him directly. Fingers crossed he has some assets even if he doesn't have a license. Was he driving a nice car or an old banger?

    I've never heard of the MIB either but it sounds like a great idea to give them a call. If you still need legal advice I went through cycleaid.co.uk who referred me to solicitors, I'm still having physio so i haven't got my money yet but their very helpful and it should be settled soon. It might be worth checking to see if you have legal expenses cover through your house insurance?

    Its a good idea to take photos of all the damage to yourself, bike and clothes and make a note of any expenses. i.e Time of work, travel expenses, physio, pain killers etc. in case you can make a claim.

    If he's no insurance you'll need to contact Motor Insurance Bureau to claim.

    I'm really sore my arm and my hip, but I still manage to go work, yeah silly me, coz the bills still coming, as a lorrie driver and can rest while loading and unloading and that's my opportunity to try 1 of the 2 beds that my lorrie got :wink: I hope my boss can't read this.

    About claims I don't know what to do, 2 years ago I was knocked over by lady who done the u turn without see me, but she's was insured, no problem, got new bike and everything paid.
    My bike is insured but should I make a claim and while I wait for the MIB claim ?
    Been told today that won't get nothing coz I came to work from personal injurys, but I don't won't anything just the bike and my stuff sorted or new.

    And guys I didn't pull the lady officer, she was really kind and upset for what happen to me :lol:

    Listen, I don't want to come across as a grump :) , but if your hip and arm are really sore, may be you shouldn't be driving in case it restricts your movement etc. You should just rest up, fella. :)

    You should be telling them fairly promptly if you think you might need to claim via them, anyway.

    Watch your premium doesn't go up for talking to them. Now, this is car related, not home insurance/bike but it may apply...

    A friend had her rear bumper scraped by a car sitting behind her in a traffic jam. After chasing them down and making them stop she got some details. Minor scuff on her car, nothing really bad.

    Anyway, she called her insurance company to say this had happened, in case the other party tried to claim on her insurance. Her insurance said she did the right thing calling them, but because she has had an "accident" it will bump her premium up. Even though the accident wasn't her fault!? And even though it was a minor scuff on the bumper!

    Seems ludicrous to me. This will of course affect her if she moves insurers too, as you have to say if you've been involved in any accidents in the last X years, and it's now on record.

    Another sorry to read you've been kocked off and injured I'm afraid. It was good there were public spirited people around to help. I hope you heal quickly and well. But if you're really in pain you shouldn't be working. Not sure where you stand with claiming from the MIB whether it is necessary to instruct a solicitor as your injuries are definitely worth seeking compensation for not just monies for repairs to your bike and damaged property. Not sure if the heads you can claim for in a conventional civil claim against an insured driver apply with the MIB. Maybe a solicitor can give you some free advice as the best way to proceed. I suspect a claim to the MIB will have certain restricitons and time limits you shoud be aware of. Not sure if you'd be able to claim for lost of earnings from the MIB if you felt going to work was not possible or feasible because of your injuries.

    The other thing is go and see your GP asap who will assess and record all your injuries. If they think it is better you do not work then I think you would be wise not to.

    Keep a diary and take lots of pics of the damage to your bike and of your injuries. Write down what happened in addition to your police statement. Get witness details. Take pics of scene of crash.

    What rotten luck. Still look on the bright side you pulled a WPC :wink: .

    The PC who attended me when I was knocked off 10 years ago didn't give me his number :roll: .

    I used to deal with insurance claims a while ago so the following may be out of date. Back then the MIB would only deal with claims for "uninsured losses" - so if your bike is covered by insurance, you will need to claim for the bike from your insurers - and then pursue a claim for any excess, loss of use of your bike, travel expenses, loss of no claims bonus and personal injury against the MIB.

    Go to the GP if you haven't had medical treatment, it will act as evidence of the injuries sustained.

    Seek advice from a solicitor - I'm sure a few people on here could recommend a firm.

    Full marks to those who stopped teh car. Very pleased they called the police as well. Not just for his attempted hit and run but because it hopefully gets another uninsured driver off the road.

    Driver was obviously a selfish a***hole if he thought he could drive with no license and just naff off. I also echo the sentiments that the ladies who intervened did sterling work.

    I really hope they throw the book at him!

    it is so complicate to get my bike fixed or new?

    already spoken with my bike insuranse company when been told that only pay me the bike not the gear and the new 1 cost £950 when my 1 was £800 :(

    i hope your feeling a bit better today dude... am sure your pretty sore.. i hope the knee is ok mate.. i've been through it myself :-((

    i've just recovered from a double leg brake and an operation on my knee after being taken out in similar circumstances.. several stitches later.. 8 weeks on crutches but now back on the bike and feels great.. thank god i always wear a lid.. saved me..
