  • Just a quick update spoke to my mate this morning who got intouch with Halfords customer services. Who stated they could not belive why he was not given a new bike !! and have offered him a FREE upgrade to the FS team for all the inconvinance he has been caused.
  • Northwind take a look at the sale of goods act, have a good read of it i think a court case would have been found in my faver, just have a read before you make comments on law which you clearly no nothing about.

    They may have found in your favour. Sometimes it is easier for the shop just to replace something than go through all the hassle, even if they think they are correct.

    Your friend is lucky to get a new bike. They were only obliged to give a new frame.

    I think this thread has highlighted for many the decent service Halfords on the whole have provided here. And what can happen when you really stretch 'the customer is always right' tactic ;-)

    Heh, how much commercial law training have you done exactly :) Less than me I reckon. You were after all misinterpreting the same law earlier in this thread, while I was correcting you :lol:

    You would lose because you couldn't demonstrate that you didn't cause the damage (apart from your incorrect assertion that you can't damage a frame without damaging the paint) and because the 4-week delay in reporting it would strongly indicate that it wasn't present when you bought the bike.

    I believe you, fwiw, but you'd not be able to prove your case, and so you'd almost certainly lose.

    Firstly I have not got a free bike upgrade, however I have reached a resolution with Halfords.
    Secondly I only posted on this site to make other Boardman FS owners aware of the frame failure so that they could check their bike to avoid any accidents. Read the original post. I only quoted what customer service i was getting when requested to do so. It was never my intention to start arguments over Halfords. Up until the frame failing I was more than happy with Halfords and the bike.
    Just to make things clear - i did not go back to the shop demanding a new bike or an upgrade. I went with the intention of just returning the bike, the manager suggested upgrading to the TEAM frame, I like supersonic thought the Team & Comp frames were the same.
    The bike had less than 10 hours of easy riding and apart from the frame was still like new. No I was not happy to ride the same frame again wondering all the time if it was going to fail. Obviously people have different expectations of the goods they buy. If the frame had failed after 6+months with regular use i would not expected anything more than a replacement frame.
    All the staff at Halfords I have had dealings with have been good even when we have not agreed.
    Finally, I have been surprised at the nastiness in some of the posts, if there's a next time i'll not bother.

    st4n, I think you've conducted yourself very well tbh, it's been the contributions from other people that I've been taking exception with. If it's seemed like I've been having a go at you I apologise, certainly didn't mean to.

  • Clearly Northwind you sem to have difficulty in reading, or you just have not looked at the sale of goods act. i will repeat it for you one more time.
    Here are a few FACTS:
    Goods are of satisfactory quality if they reach the standard that a reasonable person would regard as satisfactory, taking into account the price and any description.
    If a consumer chooses to request a repair or replacement, then for the first six months after purchase it will be for the RETAILER to PROVE the goods did conform to contract (e.g. were not inherently faulty)
    After six months and until the end of the six years, it is for the consumer to prove the lack of conformity.
    I doubt very much your level of legal training comes even close to the level of training i have recived over the past eight years.

    Subsection 3 of the S48 of the SOGA1979 doesn't apply where its application is incompatible with the nature of the goods or the nature of the lack of conformity. (that's straight from the Act, not from whatever consumer advice site you're reading.) Physical damage reported after a significant time has passed falls under this exemption.
