Spat at and verbal abuse.

On my Sunday ride I descended Holme Moss and turned left onto the A628 to Penistone.
During an uphill section there are double white lines. I looked round to see about 10 cars behind me so I moved over as far to the left as I could so I was riding on the strip of tarmac between the white line and the grass verge(technically offroad).Despite having a clear lane the car at the front of the queue wouldn't overtake until the double white lines ended. As the cars passed me a passenger in one spit at me(missed) and shouted "Get a car you f**king c*nt"
The reg.number was DA55 GKP,a black Ford Fiesta Zetec.
Does anyone on Bikeradar know where this car lives?

unless the owner of the car was actually the passenger who abused you (feasible, but unlikely), finding the location of the car will be pointless. forget about it and move on...0

Are you not responsible for the behaviour of the passengers in your car? I always thought you were. Being spat at isnt nice, I would report that.0 -
Contact the police, they have a line of enquiry, there has been a crime commited (s5 Public order) and possible driving without due consideration for other road users.
If you do nowt about it they will just carry on doing it to more people...0 -

How can you be responsible for the passengers?
The passenger is an adult - you have no power to physically restrain him - would be an assault ( unless arresting him AFTER he has committed an arrestable offence)Want to know the Spen666 behind the posts?

If you have got the reg number it's pretty easy to locate where the car owner lives, the police just contact DVLA or something similar.0
-
The passenger commited an offence for which they can be arrested.
Furthermore the driver can be given a warning under s59 of the police reform act so that if that driver OR vehicle is used in an anti social manner again the vehicle can be seized.
This is an immensely satisfying power!0 -
I know that this is a little disgusting, but if someone was to spit at me I'd be scopping it up and taking that to the cop shop as well. Hopefully the tosspots DNA would be on their database. With the reg number as well, they should be able to do something.0

If someone spat at you in a car and then there happened to be some traffic lights at the end of the road and they stopped at em, would you get off yer bike and arrest him?0 -

A similar thing happened to me a few months ago - all I will say is, it's not worth getting worked up about. I was advised by the plod that it was not worth pursuing, as the likelihood of charges being brought were extremely low, although they did have a word with the driver - even though he was not directly involved. At that stage, if the driver does not wish to provide details of his passengers, he is not obliged to do so.
I have the car and its reg number memorised though, but I am in no hurry and what goes around will eventually come around...0 -

Oh I feel so stupid for thinking something that turned out to be incorrect, thanks for sorting that one out for me Spen :roll:0 -
Stewie, you aren't totally incorrect, in certain circumstancesa driver can be held to be responsible for their passenger's actions. That is for a court to decide...0

I have arrested someone at traffic lights before whilst off duty, yes...0 -

I think you have typed something you didn't mean here. You sayif that driver ...is used in an anti social manner again the vehicle can be seized
The legislation statesWhere a constable in uniform has reasonable grounds for believing that a motor vehicle is being used on any occasion in a manner which—
(a) contravenes section 3 or 34 of the Road Traffic Act 1988 (c. 52) (careless and inconsiderate driving and prohibition of off-road driving), and
(b) is causing, or is likely to cause, alarm, distress or annoyance to members of the public,
he shall have the powers set out in subsection (3).
However, the problem here is that on the OP's account there is nothing to suggest it was the driving of the vehicle that was causing the problem. It was the actions of a passenger and there is nothing to suggest the driver was a party to this behaviour or was even aware that the passenger was going to do this. Thus the officer cannot have the reasonable grounds for belief on the facts given hereWant to know the Spen666 behind the posts?

Tell us the story please0 -
Saw car driving very erratically on my way to work, it got stopped in traffic, I pulled up alongside it, opened driver's door, driver was p*ssed. I switched off the engine and took the keys. Arrested him, called colleagues.
Rather straightforward really.0 -
Did some other drivers not think was abit odd a cyclist doing that?0
-
I got quite a few pats on the back, they guy was really and very obviously drunk...0

Sounds a good job been a policeman out and about, be awesome if you could be one of those cops in the city on bikes, but you could be a cop with police lycra shorts and that on a 2k carbon bike with Dura Ace or SRAM Red with Police decals on it
I tell ye no one not even cycle messengers would be going through red lights then :P0 -
I'd rather use it to sneak up on burglars.
When I was a PC in Stockport a colleague and I used to go out on nights in plain clothes on mountain bikes. We used to catch all sorts of baddies, it was awesome!0 -
Why not go out in plain clothes on a cyclocross? Would be awesome if the Police in Manchester let people volunteer to go around patroling on bicycles looking for bad guys, I'd love that and do it on my roadie! , would make allot of wasted time useful time!0

The Police can easily check the reg of the car on the PNC. A sec 59 notice can be issued for anti social behaviour no problem, and it be recorded on the PNC & held for 12 months. The Police can arrest anyone for 'absolutely anything' as long as they have a justified grounds. But the Police can't take any positive action if they don't know what's gone on can they? Report it for the following reasons:
1) The vehicle may be known, and the Police may have an interest in it, or persons associated to it. They may be looking to use any 'tactic' to 'harass' said veh or persons? Little things can lead to big things. eg. The car is stopped down the line because of you report. Once vehicle is stopped Police smell weed inside, and vehicle get searched. Drugs are found or stolen property etc, you get the gist = all get arrested & charged etc, etc. All because of your report!!!
2) If the vehicle is involved in another incident, (nothing to do with you - down the line) when someone else complains the Police are more inclided to believe the inoccent party, and can use your incident to support someone elses weak case. Likewise if you run into the vehicle again, the previous report will assist you.
3 If persons in the vehicle were acting like t0ssers, there's a possibility that there many have been another incident reported nearby or around the same time. Several minor incidents can add up to make a strong case?
As someone in the know I can say it will be hit & miss as to how its dealt with! It will depend on who you local Fed is, the Offiicer dealing etc, but as already stated it will make you feel better, and once reported move on."I spend my petrol money on Bikes, Beer, Pizza, and Donuts "

Many many years ago when I was at university a housemate who was cycling home down the Moulseccombe Road back into Brighton was being buzzed by a white transit van with 3 builder/brickie types inside. Anyway they buzzed him then drove on probably tthinking hey wouldn't ever see him again. However my mate was a pretty handy club sprinter he caught them up about 3 sets of lights later and me a few seconds later. I was seriousy whacked. Should have seen their surprised faces as my mate pulled along the nearside door of the van. My mate was built like a sh1t brick house 6'4". Anyway the one in the passenger seat then stupidly winds down the window about 6 inches then spits at my mate. Bad move. My mate then punched the door so hard I was certain his hand was going to go through it. The dent was immense. You should have seen their faces it was a picture. In an instant my mate was off his bike had propped it against the railings and was turning back to them. The driver then RLJ'd and they were off presumably crapping themselves. Their faces were a picture. It was hilarious, obviously not so good for my mate with spit on his jersey but I don't think they ever did that again.
Obviously I don't condone this sort of thing but it sorted them out better than the then police ever could do.Life is like a roll of toilet paper; long and useful, but always ends at the wrong moment. Anon.
Think how stupid the average person is.......
half of them are even more stupid than you first thought.0 -
