Manitou "marvel"

I purchased a Bergamont Revox 7 its is fantastic! However... the Manitou Marvel forks failed to lock out and when I serviced them the shutoff washers had fallen into the bottom half of the stanchion. I have contacted Bergamont and they pit me onto Manitou. So far since March when the issue became apparent they have not even attempted any contact.
Has anyone else had a similar issues dealing with Manitou?
So far they have been super lame.

    Photos of the damper might show the problem.
    What do you mean by 'failed to lock out', a fork can still compress when locked out it if it hits a bump.
    Did you have this problem before you serviced it?
    How did you service the fork, what did you pull apart?
    Does anything look broken on the damper?
  • The problem started after locking out the damper. After that it never locked again. When I serviced it the bittom part of the compression damper was loose in he borrom of the forkswirh a push fit rivet.
    Had I not serviced it I would not have uncovered it.
    After posting this I had contact from Manitou and so far we are sorting it.
    I have also fabricated a work around and it is working.
    As for taking it back to the shop I work there.
