Pothole caused a crash, can I get compensation?

    At the end of the day its the councils responsibility to ensure the road is safe to use, therefore if they feel the need to claim against BT (or whoever done the digging) that still shouldn't prevent you from claiming against them.

    As for "thecycleclinic". I don't agree. The OP was injured and suffered losses (damage to his property) due to neglect from another party (the council), why is he not entitled to compensation?

    He shouldn't have been riding his bike on that road if he didn't want to crash. Aaaaaand if he did happen to crash on another poorly repaired/neglected road he should be riding something that's he's prepared/able to afford replacing time and time again due to no fault of his own, obviously!

    There seems to be a lot of money for a lot of other shite... it's the government's decision to tax lightly and have developing world's services and infrastructure... one could go the other way, but it needs vision and I'm afraid politics are a bunch of cowards...

    nah, we dont get a choice in paying council or income tax and therefore if the law says they are responsible for properly maintained roads then thats the deal we have with them.

    If anyone accepts crashing in pot holes a normal consequence of riding a bike on the road, then they need to think about not gravel rash but what about a broken back or severe brain damage? these injuries are not quite so easy to poo hoo are they.

    Also, its all good and well thinking that you should see the potholes and avoid them, when cycling in the light and when its dry. But if the pothole fills with water and you assume its a puddle only to find out its a 6 inch deep cavern, what then?

    It would be great if the council fixed them all when told, but they dont. And they will avoid doing this until they really, REALLY, REALLY need to and then begrudgingly.

    Unfortunately, it is fast becoming the only lever we have to get councils to fix the pot-holes - to make them feel the pain of paying out compensation when they fail to do their jobs properly. If you feel bad about it, feel free to donate the compensation to charity and pay for your new bike out of your own pocket.

    That, instead of spending millions on consultants that are supposed to save them money by advising them to not repair the roads...

    Well i'd like to think that the OP did report it after the incident.

    "wanksy" came (ooh did he :) ) about because the lack of effort from his council to repair potholes that IIRC he had reported. Started spraying them and they got repaired quicker. Although they did claim that it cost more to remove the drawings that it did to repair the hole, which i highly doubt.
