Defy Advanced front brake issue

Hi again everyone, I've been getting front rotor rub on the calliper mount when climbing out of the saddle or sprinting which feels like the front brake is on, my LBS is useless saying it's common on the defy (which I find hard to believe), I've also sent Giant UK an email asking for help. I've realigned the caliper many times over the last week with no joy, also checked everything is torqued down correctly again with no joy, the fact that it only happens when I'm out of the saddle makes me think it's the wheel flexing but this shouldn't happen yes ? anyway I'm at a loss to why and it's gone beyond annoying now, PLEASE HELP :(

Description is of a disc braked bike, no? The rotor actually hitting the caliper mount sounds pretty serious to me. I'd be complaining to the retailer if the bike's fairly new.

flexy fork or qr? qr not tight enough?

try a different qr, put weight on the bars before tightening the qr to make 100% sure the wheel is fully seated in the drops
my bike - faster than god's and twice as shiny

It's new ish 2 weeks old and 250 miles under its belt, I've been to the Giant approved retailer I bought it from and all I got was "it's common on the defy with no real fix" basically stop complaining was there response, now it goes without saying I've left the shop in question and gone straight to giant for an answer but currently with no reply. The tolerance on this stock wheelset (P-SL1) between the rotor and calliper mount is very tight (about 2mm) so maybe this has something to do with it.

I can't comment on the fork flexing but I make sure my hubs are properly seated and done up tight probably too tight but this shouldn't have an impact if anything making the wheel stiffer in the fork no ?
