Cyclist paralysed, fine and points awarded!

Sorry if I've posted this in the wrong place or it is a repeat of information provided already - just a bit angry about the institutional contempt for cyclists.

    It's not a failure of justice at all. In fact it's actually the correct application of justice according to the offence charged and the sentencing guidelines.

    What it is is a failure of successive governments to deal properly with the gaping hole in the law which fails to deal with causing any injury by careless driving. Until that is addressed the justice system will quite properly deal with cases such as this in this way.

    Well, justice has been administered according to the law of the land in the correct way. That's a definition of justice. The fair application of law. The theory of justice asks us to examine whether there should be alternative laws. It's possible to have a just outcome aligned with justice and evidence a legal injustice at the same time. That's why it's not a complete failure of justice.

    And that's rather my point in using the word justice in the first place. To demonstrate that we need to think clearly about why things are as they are and try and change them. We really need that injury by careless driving charge. Sadly it won't be perfect, sentencing will still be less than injury by dangerous, but it's a start.
