Faulty Focus Cayo

Hello all, I would be interested to know has anyone out there has had either frame paint issues or poor customer service from Focus? (Derby Bikes Group)
I have a 3 x month old Cayo 7 Carbon and only noticed a few weeks ago that there was a lined buble in the paint on the front of the head tube, this then spread further up the tube on another ride and then a piece of paint flaked off.
What happened from then was a joke, my retailer decided to sit on the fence, wouldn’t inspect and write a report, make any comments or even offer to replace etc, as he was concerned in getting a returns credit, even though he doesn’t understand the Sales of goods act!! He insisted this was upto Focus.
So the Focus warranty dept looked at the photo’s I had taken and they kindly said that the bike had been impacted or crashed, as this was completely un true the bike has no marks, scuffs or scratches and the wheel is as new, it has never been in any accident at all it is clear to see when you physically see it….
So they said we are rejecting a claim, even though they haven’t even looked at the bike!!
Only by me having to send lengthy emails to all involved, most of them were all un-answered, sending messages on Focus bikes facebook pages (which then they decided to block me) I made contact with their European sales director via Linkedin. He then decided to inspect the bike, but it has to be sent to Germany which could take weeks. I haven’t been able to ride now for 2 x weeks as I was told not to. Focus bikes T+C’s are incorrect v what action they have taken, my questions regarding these are still un-answered, they have no UK support, one man apparently and he is on holiday, no UK office or warranty support it’s all through Germany and broken English on email replies…..
Great bike until this happened but I believe you shouldn’t have to fight like this when you have a problem, so the bike is in transit somewhere as I speak and have no idea what is going to happen or even when I will get it back.
Thanks Focus bikes….

as your contract is with the seller it has nothing to do with Derby. it is up to him to follow that up whenever. as he is not fulfilling his side of the contract I would have a chat with CAB so you can make him aware of his obligations. ie he sorts it out or refunds you."Do not follow where the path may lead, Go instead where there is no path, and Leave a Trail."

Nice use of paragraphs.
You should have done it all in upper case for full effect though.
Another one for first post hall of fame I think.
To offer some balance to the Focus slagging thread title, I have had my Izalco 3 years now (finance just paid off (mini fist punch)) and it has been a superb bike to own.0 -

I had one of the very early Focus Cayos, brilliant bikes.
As Nicklouse says, your contract is with the retailer.I'm sorry you don't believe in miracles0 -

Nice comeback!
If you stick around you'll get used to the warm friendly welcome from some members!
Good luck with your claim - as already stated your contract is with the retailer so don't let yourself get fobbed off0 -
Don't get disheartened by the few turnips on here wanting to give you grammar lessons. Hope it works out for you.0

It's not the CAB that the OP needed to see, it's Trading Standards. They are the ones who would pay the retailer a visit and have him fall into line with following the Sale of Goods Act, lest he wants to end up in court. To err is human, but to make a real balls up takes a super computer.0 -

Nice second post0 -
Focus and Wiggle dealt with my warranty claim on my Focus impeccably.
You are really chasing the wrong person though. Get your retailer to sort it
