Police accessing Sun's phone records

So the Sun is taking the Police to court for accessing phone records. This is the paper that accessed Milly Dowler's voice mail messages and deleted some giving her family false hope that she was alive.
To be honest I think there are certain cases in which the courts should be able to ask if the claimant is having a laugh and throw them out of court with a hefty bill for wasting the courts time. Yes, the press should be able to protect their sources. But whining about phone records being accessed just smacks of hypocrisy.
