Radon - Massive Fail

A warning for anybody considering buying a Radon from bike-discount.de
This is my Black Sin 10 SL after 4 days of normal XC riding, from new. No crashes, nothing different to what all my other bikes (including a very lightweight Cannondale) have been through for years with no major problems. The retailer has immediately stated this is my problem and not covered under warranty. Suddenly it doesn't look like good value anymore. Make your own mind up who you trust when investing in a new bike; I regret not going for a more expensive brand with a track record in looking after customers when things go wrong, as so often they do with lightweight parts. After sales reputation is everything when investing significant amounts of cash in something you want to last more than a week.
If anybody has any experience pursuing warranty claims against companies in denial, I would love to hear from you!

I see a crack and what look like some serious scratches - better pictures maybe?
Why do they state it's your problem (presumably Bike Discount)?

Does the UK sale of goods act apply when you buy from an overseas supplier?

This is nothing to do with warranty - your basic sales of good rights, and the UK laws exist for people selling in the UK.

It is up to the retailer to prove the goods are not faulty if they think you have mishandled it (up to 6 month - then is up to you to prove is faulty).

retailers in Germany have to follow the EU law on sales which is 2 years. not sure if its the same as here where the retailer has to prove its not a manufacturing fault in the first 6 months or not.

Touch wood....but I own Radon hardtail and so far no problems at all, and I am built for comfort not speed :D . About a year and a half old now and seems well built to me, I havn't had to test out their warranty though. Seem to be well regarded in Europe when I was researching into buying my bike.

Have you tried ringing them up? I used one of those cheap calls to Germany numbers when I enquired about sizing and they speak good English. Seemed helpfull on the phone but they always do when it is a possible sales call.

Hope you get sorted out though. Maybe you should direct them to your post on a very popular forums...

The retailer has to prove it, without a doubt.

Thanks for the advice - so far the Bike Discount Service Centre person (Christian Schmidt) has dismissed this as 'obviously' my fault and 'there is no warranty claim' from viewing the picture sent to him.

I have ridden carbon frames in the past on some challenging terrain (including the occasional stack) with no damage, so deeply unimpressed by the QA on this - maybe I just go a Friday afternoon job!

Perhaps the noticeable scratching is giving the impression of crash damage ?

So, no crashes, yet a lot of serious looking scratches to the left of the snap suggesting an impact of sorts. Mmmm... Perhaps that's the issue they have with your claim...

Ask them for a report outlining the nature of the failure.

SS is spot on here, follow his advice, however looking at your photo there is what looks like obvious scratching and gouging to the left of the tube and also what looks like a half moon mark by the main crack which could suggest a delamination from impact, I would suggest this is what Radon are basing their response on.

I'm in the more photos band here.
Is that the only photo you have sent them? The scratches may be innocuous but they look serious being so close to the crack.

Yeah, I think someone is telling porkies. How did those scratches surrounding the crack find their way there if you haven't crashed it?
