Bent dropout and hanger

Hello all,
I recently purchased a MTB off ebay. When the bike arrived the hanger and dropout had been damaged. So much that I can't get the wheel on. I replaced the hanger but the dropout has been bent inwards.
I took it to 2 LBS's in my city. They both told me that they couldn't help due to the frame being aluminium and them being liable in case of it cracking.
The guy that sent it used Paisley Freight with no insurance so we won't be getting anything from them.
HE has ben very helpful trying to remedy the problem - contacting a few frame repair specialists. I found one in Lancaster ~Atlantic - boulevard. The seller has offered to pay the cost of postage and the cost of the repairs.
I'm worried as I have no guarantee that this will be fixed and I will be left with a dud bike.
What do you recommend that I do
- should I send it down to get fixed, risking being left with a problem bike. IT is the rear dropout that the rear mech attaches, which may cause ghost shifting or other problems.
Or should I just return to sender as it is not as described on ebay IE it doesn't work and is damaged.
I'm really not sure what to do here any advice would be very welcome.
I tried attaching a couple of photo's but they are too large and I can't reduce the size of them at my work.

I'd send it back if you can't get it easily repaired.
Did you pay by Paypal?0 -
If all else fails and you could run it single speed. Not ideal but it can be done with a tensioner0

Yeah I used Paypal. I genuinely think the guy is on the level. I guess that doesn't really matter, I have a bike that doesn't work... Thanks for the replies0

He may well be on the level, but he should have sent it out insured
You could try and get it fixed, depends how much you want the bike

Unless an insured option was available and you chose not to take it in which case the risk was yours, not his....0
