Cracked Frame, new bike?

I have had by 2 1/2 yr old Bianchi Via Nirone in the LBS a number of times in the last month or two. It just wasn't feeling quite right. The Mech kept it for a more thorough once over and has called today to inform me that there's a 2" crack where the down tube meets the BB case. Anyone have any experience of dealing with Evans/Bianchi over warranty matters? If I'm 'warrantied', chances of upping the cash for a better bike/which bike in their range?

I don't know what their warranty is but isn't there something about a product should last for a reasonable length of time. I think it's unreasonable for a frame to crack after 2 1/2 years so they should help you out in some way at the very least.
I'm sure somebody that knows what they're talking about with respect to consumer rights will be along shortly to say what the situation really is.

Very unlikely you have any recourse under the SOGA. However you may still have some with a warranty, if there is one.0

Thanks, hopefully Evans, who sold the bike through R2W can per sue Bianchi re the warranty. I do fancy an upgrade.Bianchi Nirone C2C FCN40

Chance of an upgrade is slim indeed. It'll be send the bike to bianchi uk, they'll replace the frame and give it back at their leisure.0
