Hit by car

Hi folk,s, at the weekend I was hit by a guy in a freelander, right down the side, spat out back and sent out to the middle of the road, :( , bike look,s as good as me, few chucks missing and gravel rash, kind of wondering, all my mate,s say get someone on your case, but all I can find is no win, no fee, anyone got a better idea, many thanks, sore kiddie :(

    The CTC can put you in touch with solicitors that have experience in this area, but in future it's worth having 3rd party insurance with British Cycling or the CTC. Hope you get it all sorted.

    Talk to a specialist Personal injury law firm who should offer you a free consultation. Once they have the facts they may choose to offer no win no fee. Its just a commercial proposition and doesn't mean dealing with ambulance chasing call centres.

    Unless you have legal insurance or a spare 2-3k to fund your case, no win no fee is possibly your best option. Be aware that you should read the ts and cs carefully and may be "required" to accept an offer that your lawyer deems acceptable because they have skin in the game.

    straight forward damages and PI claim should not take too much effort:
    1. establish liability
    2. establish damages
    3. satisfy strict proof (prove your case)
    4. cash the cheque

    in the meantime document the accident including your damages and injuries.
  • Just hearing about this makes me angry. If only the 'Justice Zone' from Red Dwarf really existed.

    Do you have any witnesses? Do you have legal cover on your car insurance?

    must be something in the air.. my mate got knocked off this week also, but the car never stopped for him,

    he did get a couple of witnessed but nobody got the cars reg number who knocked him off..

    not sure what happens in a case like this, but it doesnt look good for getting any result

    As per other replies, contact a PI solicitor. I am going through exactly the same, and its very straightforward, at least mine is. I just used a firm of solicitors in Sheffield, not one that advertises on TV, all seems above board.

    They will recover their costs from the other party, send me for medical exams etc. I imagine doing it yerself would be a nightmare. In my case, the other insurer is paying for private physio also, presumably not for my benefit, but in hope to reduce their payout.

    Write down all that happened, including hospital visits, costs etc etc.

    I went through this about 5 years ago. The guy stopped and took me home with my bent bike. I attended local casualty dept after I got home to get checked out and make my road rash official. LBS gave me bike friendly NWNF solicitors name and even though the driver admitted liability it took his insurance co 11 months to pay out.
    A good outcome, eventually, but it did take almost a year, even though the driver was spoken to by the Police as the guy had no road tax.

    Had an encounter with a driver and some tram tracks on the road just recently. British Cycling membership... well worth it.
