Wheel alignment issue

I've recently bought a wheelset direct from the manufacturer, and was intially very happy with them. However, on the weekend's club run it was pointed out that the rear wheel alignment appears to be out (on the drive side) by about 3mm.

I have emailed the manufacturer who've replied saying that this misalignment is within their wheelbuild tolerances, and so they will not do anything about it.
Is this unreaonable, or am I just too fussy? Also, are there likely to be any safety issues if I continue using the wheel?

    3 mm is a lot... ridiculous to claim it's within tolerance... the tyre will not wear homogeneously, the braking will not be ideal and the bike won't handle properly, especially in twisty descents. The bike will be very dangerous to ride with no hands and in cross winds.

    Chances are the spokes on the NDS have come loose and will soon start breaking if you don't act.

    Assuming that the issues is that the dish is out by 3mm (i.e. the wheel is true but the rim isn't central) then the wheel may be strong but it's a hell of a long way out.

    If the wheel isn't true and has a 3mm curve then it's in desperate need of fixing. It's not within any reasonable definition of tolerance for a wheel straight off the truing stand in either case.
