1st accident

Had my first accident :(

Coming off a rounabout, a car decided not to stop and hit me. My bike is ruined and Im nursing bruised ribsand a sore hip. Now to start the claim process for my bike and gear

    No accident is a good one, but at least you actually walked away from scene, could have been worse

    Not good dude, and certainly a shock to the system - still, any one you can walk away from...

    As for claims etc, make sure you notify the police, crime number etc, and read this.

    One of the two reasons why I joined British Cycling - help in the event an accident. Liability insurance being the other reason.

    I hope you get things sorted out okay.

    Is british cycling the best? I did sihnup for cyclegaurd, but im hearing bad reports

    Can't answer that sorry. I didn't really hunt around much - it was CTC vs BC for me, but as far as I could tell you have to wear sandals and socks to join CTC :)

    I thought Cycleguard was more to cover the cost replacement of the bike, rather than a back-room effort on the legal side of things. I thought BC and CTC had preferred legal bodies they referred all their cases to?

    I'm using BC at the moment for claiming back for the crash I had on Tuesday that destroyed my bike (and my helmet!). The process seems simple enough and the legal firm they use are very helpful.

    I used a local solicitors after my accident 5 years ago and they started a no win no fee claim. The 86 year old guy who rammed into the back of me on a straight accepted liability so the case didn't go to court. The solicitor did everything for me and got me a very nice payout. I wasn't going to bother claiming at first but my nephew was working at a solicitors at the time and told me to come for a free consultation.

    had my 1st accident today, 23mph on the drops, took one hand off to get a drink, hit pothole, bam. fell. ambulance and A&E sorted me out. bad roadrash and chunks of flesh missing :( confidence dented, bike mechanically ok, cosmetically 105 brake levers mashed a bit. will get a long sleeve jersey! added pic for effect!

    You don't have to be a member of CTC or BC to use their legal teams. You can approach them individually and go with a no win no fee arrangement. The benefits of CTC and (I think) BC is that they include indemnity insurance if you're the guilty party.
  • In two weeks time it will have been a year since I got hit by a car. I went with a firm called White Dalton as they are a motorcycle specialist and therefore the majority of their work involves two wheels. They have been a god send and always explain things so as not to confuse us non legal folk.

    Things to be aware of. The process is lengthly (my claim is still ongoing) even if your injuries appear minor at the moment there is the chance you've got some lasting damage. I didn't break any bones thankfully but my hand still isn't 100% by any means.

    The paperwork involved in a claim is immense. You literally have no idea until you have to go through the process. It gets to the point where the amount of time involved collecting information and filling forms in almost isn't worth the claim.

    On the flip side I'm glad I'm not dealing directly with the insurer of the driver as they could have been giving me the run around for months. Letting my solicitor deal with it has surely saved me a lot of stress and time and doesn't actually cost me a penny.

    Took 3.5 years to get mine sorted. Next time I think I'll just kill the driver and be done with it. :twisted:

    Update on my accident

    My LBS had a look at my bike and the damage comes to £80

    Front wheel buckled - Needs trueing
    Back wheel same
    Ripped bar tape to be replaced
    Front brakes re alligned.

    Ill pay it myself and let my solicitor deal with the rest and I can claim it back if the accused does not play ball. If she offers to pay without going through her insurance thats it all sorted.

    If you've already got solicitors involved then go through the driver's insurance, keep it all open, legit and above board or you run the risk of being stung.
