Attention! CUBE AMS 29er buyers

I've just returned to mountain biking after a long period, and decided to buy a new bike. After about a month(!) of looking on whats best i opted for the CUBE AMS 29er because of its spec, but it was a close call for the Scott.
Anyway, I ordered from Hargroves cycles who were exceptional, and everything was delivered in time. (BTW if you tell them you wanted the 0% finance but couldn't get it, and therefore they are going to be better off by 10%, then they'll give you £150 of vouchers to spend! Bonza )
But, the bike was delivered with a FOX Evolution RP23 shock instead of the advertised (as per Cubes site and Hargroves site) a Fox Factory Rp23, which is a considerable drop in specification and price.
It takes ages to figure out what is the best bike to get and like i said, the reason i went for the CUBE was because of the high spec which cube are well known for, so it was a kick in the balls when i got a bike with lower spec??
I've contacted CUBE directly to see what they say, before going back to Hargroves. For anyone reading this, i'll keep you updated with the outcome.
Its a shame as it's ruined what was a great buy into something i may not have bought. :x

So whats the difference in spec between the 2 shocks then to get you so concerned? Links?
Generally, its a bargain of a buy no matter which shock you got..0 -
as CD says specs can change, have you tried the bike, is the shock not doing what it should be?0

cooldad; I see that they do say that on the site and I'll admit to not knowing the law on this by heart but I don't think they can do that actually, especially when it's clearly a downspec, without notifying you. if you bought a large coffee and were served a small one you wouldn't expect that a notice saying "coffee size may vary without notice" to be sufficient excuse.
on a different note, monkey; the law does give you a month to return the product unused for a refund. ofc the cost of returning is then for you although I'd think that Hargroves would probably agree to swallow that in the circumstances or provide a discount to represent the difference in spec
Dodge, google "fox Shox", they have 3 ranges, from top to bottom Factory, Performace, Evolution. I've not gone thorugh the details (because I don't care that much) but I'm guessing kashima coat and damping adjustment maybe different

Yes they can do it, because in the T&Cs it says that. However, under distance selling regs you can send the bike back because of it and they're legally obliged to give you a refund.
Weirdly this came up yesterday on STW, someone getting their knickers in a twist because a bike came with the wrong tyres.
As said though, what's actually wrong with the shock? If it came with no decal would you know it was wrong!?0 -

like I said, I'm not 100% sure but I think you're wrong on that. misrepresenting a product is not legal, no matter what T&Cs are written in. if I am right (IF) then the T&C clause is illegal and therefore void, as would a clause stating "no returns or refunds" when the distance regs state that you canEverything in moderation ... except beer

If you don't care that much then why is it a problem?

Nick is right - if you bought the item from the retailer and it is not the spec THEY were advertising (forget Cube, they can change specs of the bikes, many do), then you have a right to be compensated.0

I appreciate that i need to go to Hargroves as i bought the bike from them and since posting hargroves said that they just copy the spec from the cube website which is understandable. BUT, what annoys me is that cube must know that one line on their own website is blatantly wrong, and since the difference in the two is about £200 its serious component to get wrong and mis advertise on. If it were just tyres/seats because they ran out stock of the advertised ones i wouldn't mind, but a main component is a push to fall under "spec might be subject to change"
If i bought a new car that was specked with ceramic brakes and i got steel ones, they still do a job, and most people wouldn't notice the difference, but i'd be pissed as the price would be about £5k different. The main issue is, if mine is the only one out there with lesser spec, I suffer on the resale value. Hargroves haven't swapped one out to make money, it's Cube that are mis advertising.

Checked my mates yesterday, his has the factory rp23 rear shock, not kashima though. Oh and evolution forks.0

It's up to Hargroves to make sure their site is accurate, so no excuse. If you've spoken to them, and it sounds like you have go back and call them out.I don't do smileys.
