avid bb7 loose cable pull lever. is it faulty?

Hi
just got a brand new BB7 caliper and the actuation lever on the caliper seems to have quite a bit side to side play on it. if i push the lever side to side i can also see the outboard pad moving around
is this a Dead on arrival one?

I seem to remember mine had some play in the lever. Once it was all set up it wasn't noticable at all though.0
