Insurance Woes

Hello,

I was wondering if anyone had any thoughts on the following?

A friend of mine was recently knocked off his bike coming back from a training ride. He was riding in a marked cycle lane in broad daylight through a busy town centre when a woman, without indicating (backed up by witnesses at the scene), basically went to turn into a road on the left, essentially driving through and into my friend and sending him flying. Injury-wise he was reasonably lucky - bad concussion (helmet split in half), chipped elbow, road rash and bruises. His entire bike was a complete write-off, as coroborated in a written report by his LBS, his Garmin was smashed and clothing ruined. The woman admitted liability and passed on her insurance details.
Having received 3 written reports on the extent of the bikes damage, her insurance company have finally come back to him and are basically offering to only pay approx 1/3rd the value of the bike, taking into account depreciation etc. Should they not put him in the same position that he was in before the accident, i.e. on a similiar spec bike at the value he originally paid with the same equipment?

Anyone had any similar experiences?

    He should just refuse the offer, insurance companies always make stupid offers in the first instance.

    if he has no legal insurance, tell him to get a copy of cycling weekly and contact one of the no-win no-fee law firms who advertise in it, with liability admitted they should make mincemeat of the insurer

    if he hasn't already done so, he better start making a list of everything damaged including clothing, extra cost incurred, loss of earnings, etc. etc.

    +1, insurance companies will always try it on. As the accident was not your friend's fault, demand like for like, or the up to date equivalent.

    Thanks all, that's exactly what he's going to do and is currently talking to a couple of solicitors.

    Whether its house, bike or car these flippin' insurance companies always always try it on. They clamour to sign you up and take your money but when it comes to actually making a reasonable claim, sheesh!
