Is there and equivalent of TUPE protection in the US. or if you have a service outsourced to you are you free to use your own people(either in the US or overseas) and get rid of any incumbents you don't need?

    Are you talkinng ex-pat US employees TUPE'd. I.e. employed from UK to work overseas or outsourced to overseas?

    I think that any TUPE would be contractual negotiated in the USA - i.e. per person/per company basis, I don't think that there is a default guarentee. I believe that there was a year guarentee (by grace of the employer) on proviso that the person in question fitted the job - i.e. HR can make the job not fit the person/persons.

    Went through this about a year ago with HR, turned into a minefield - although it was much easier to reduce workforce in the USA than the UK.

    TUPE is an EU concept - not sure it exists in the US
