frame twisting on GIANT REIGNX2 2010

could anybody help me? i bought bike in may Ithink (looking for receipt) and today while climbing I noticed the right pedal is hitting the rear arm while the pressure is on the left. This took a while to fathom.....
Every time there is pressure on either pedal the center of bike seems to twist.
What is causing this and will it be covered under the warrenty?
All riding ceased as soon as I realised there was a problem.
Can anybody help?

cracked frame?

Is this a new develepment? Check crank arm and suspesnion pivots are torqued correctly, and the bearings are not wobbling.
Then check frame for cracks.0 -

just to let you guys know .....it was the pivot arm on the drive side had snapped.....couldnt see problem due to chain stay etc blocking view....all sorted!0
