Taken from the Border Agency web site:
    High-value migrants

Investors, entrepreneurs, exceptionally talented people and recent graduates from UK universities can apply to enter or stay in the UK without needing a job offer - but you will need to pass a points-based assessment.

    Skilled workers

If you have been offered a skilled job in the UK and your prospective employer is willing to sponsor you, you can apply to come or remain here to do that job.

So the answer is, you will need to apply and pass assessment.
To err is human, but to make a real balls up takes a super computer.

Jesus that assessment can't be that hard to pass.

Have someone working who was on a student visa. Then said they started work at a consultancy in the UK which turns out to be a residential house and all contact details are in Nigeria.

Claims to have all sorts of accreditation that were gained overseas. Has no actual knowledge though of the topics they have the accreditation for.

Surely a workplace has to check a person has a legitimate visa?

Yes every workplace should ask for passport to prove your british or right to work in the uk visa. There must be someone on here from HR who knows all the rules properly.

  • I was in the UK on a student visa, and it is A. not possible to work without this visa, or remain over 3 months. If there are records of them having worked, and the visa being expired, but no record of them leaving, UK border agency will be by the workplace eventually trying to find out what is going on.

If they are on a student visa, you have not seen it, and the border agency finds this, I believe you can also be fined as a workplace for hiring someone who has not proved the right to work. if this was faked, you would have a few small forms to fill out or so, but not a big headache.

However, if they really do seem like they have lied on the application process, request the copies of the accreditations within 24 hours, and if unable to produce these, then someting is extremely fishy. Border agency would have asked to see them, and most likely they would have them in the country for safety should anyone ask for them.
