There is a possibility of air loss every time the seal moves over that area, with the possibility of rubbing the seal so eventually the seal will no longer hold air.
I would send it back and ask for a refund, or buy another new piston and get it fitted, probably cost more than you paid for the shock.
There are not meant to be any marks or scratches on the piston.--

I wouldn't bother as long as its not rough - that is if you like the value of the shock - I had a similar size scratch on an RP2 and I can't say I ever noticed. As long as the scratch isn't vertically longer than the seal (about 3mm IIRC) then nothing should leak badly as the seal is always 'sealed' on at least some of its depth.A Flock of Birds
