Knocked off my bike!

I got knocked off my bike yesterday and ended up with a broken elbow - gutted. :( I was pretty shook up at the time and didn't get any details, although she told me she worked in the office of the school that she was pulling out of when she hit me. My bike is damaged too and i'm looking to put a claim in. I reported the accident to the police today and i'm going in to the office on monday to get her details and try to find if there's any CCTV footage.

Any advice?

    She must report it to the police as soon as possible and within 24 hours otherwise she commits a further offence of failing to report an injury RTC. Did you get her registration at the time just in case she doesn't work in the office?

    Thats sucks mate, but why didn't you get the police involved at the time of the accident?

    They should of been there taking a statement from her and also getting her to (hopefully) admit full responsibility for the accident there and then. If she was completely at fault?

    Insurance claims are never straight forward, but you have a lot more to work with if everything is crystal clear that the policy holder is at complete fault.

    How bad is the damage to the bike?

    Nightmare mate. I'm in the same boat and it sucks big time (badly broken wrist after being knocked down by an old woman driving on the wrong side of the road round a corner).

    That sticky in Commuting is great. Use it.

    But be warned that it's going to take a LONG time for your claim to complete :cry:

    I got hit off my bike on the 19th of June. By the end of that month the insurance money was cleared into my account.

    Not suggesting that some people dont have a nightmare with claims, but if its a straight forward case and you have everything in place it doesn't have to drag out into months or even years.

    Yeah that sticky is really useful. I didn't get any details at all - not even her reg. I've been sat here telling myself how stupid i am for not getting details, the police, or an ambulance. I just keep coming back to the fact that i was pretty shook up, and it's the first time it's happened to me. Hopefully it won't, but if it does ever happen again i know what to do. Like has been said above - at least i'm still alive. I just hope now that she does actually work where she said.
    The bike isn't too bad. One of the hoods has bent in and i think a few of the teeth on the chain ring have bent. Other than that i think it's ok, but i'm (or more accurately my wife is) taking it to LBS on monday to get it sorted out - and making sure i keep the receipt

    Money from your own insurance company for your damaged bike or money from the insurance company of the person who knocked you off your bike? Were you physicaly damaged?

    Money from their insurance mate. Why would I go through mine when it was them at fault. I did damage my shoulder, however after some very good advice we dealt with getting money for the replacment frame first. If i'd of gone through a claim for my shoulder at the same time im sure it would of gone on and on.

    As far as I can tell, insurance companies seem keen to settle quickly up to a sum of around £1500. It's in their interest to get it sorted before expensive medical treatments present themselves.

    OP: don't worry until you've visited the school tomorrow. Chances are she will have been completely honest (funnily enough most people are). Stay calm when you speak to her and just explain that you need her insurance details and that you will have to report it to the police. Do also get your bike fully checked by a respected bike shop as serious damage is not all completely obvious.

    I'm now 9 months into my accident claim and I have only received an interim (and standard) £1000.

    Most importantly, glad you are ok.

    I see, everything at once. The very thing I was adviced not to do. I did bike first. I got hit on the Sunday afternoon, by the Wednesday they had emails with photos showing the damage, faxed confirmation from my LBS confirming frame was a write off and replacment costs, links to sites where replacment parts could be found etc etc. They gave me figure on the Friday, paid the money directly into my account on the following Monday and it was cleared by 4pm on the Tuesday.

    Good luck with it anyway mate! Hope it all works out

    I got knocked off last April.
    It took about 3 months for the bike money to come through and maybe another 4 for the injury claim to come through. I didn't want to put an injury claim in, i would've been more than happy just to get my bike back, but the drivers insurance company lied on various occasions and then they passed my details on to a no win no fee ambulance chaser! In the end i screwed them for what i could get. .

    i got knocked off my bike last November. Bike was written off and prsonal injury to shoulder, damge to lohing and hlemet.
    Driver at irst tried to blame me for the accident, he admitted liability once solicitors got involved. Finally settled in may for cost of bike, clothing, personal injury and out of pocket travel expenses. Settled in May!!

    I was paid for damage within 6 weeks, but PI side is running at over 2 and a half years. I've had my shoulder decompressed, but have permanent nerve damage in my neck, which is causing pain along my whole arm - this will be with me for life.

    I got up and cycled home from my accident, didn't break anything, but the damage was done. So be careful, and get fully checked, and don't agree settlement until you know what's wrong.

    To the OP report to police, then call in school. Heal quick.

    I am sorry but I find this completely unbelievable. From the time of the accident to the time you got paid out was basically 5 working days!! Utter, utter BS!!

    If that is actually true please name the insurance company because they deserve recognition for possibly the quickest resolution of an insurance claim ever and I would like to join them - as I am sure many others would!!

    What exactly did you tell them and what documents did you have to send?

    What information and disclosure from the police and their insurance company did you submit?

    I would love to know what insurance company pays out within 3 working days of recieving all documents after an accident that only happened 5 working days before!!

    You said you hurt your elbow. Did you land on your head? I don't get why you are claiming for a helmet. You landed on your elbow didn't you? So your head, or helmet came nowhere near the ground - did it?

    What exactly happened to you and what actually got damaged as a result of this accident?

    Do you have any independent witnesses? I assume you were cycling completely legally when this occurred?

    I haven't read the whole thread, so apologies if I'm astray.

    My partner was recently hit from behind by a car that was in turn hit from behind whilst stationary at the lights. The driver at fault admitted liability on the spot, everyone swapped details. This was on a Friday evening. The repair centre took our car in on the Monday and a hire car was provided. We picked up the car repaired and fully valeted on the Thursday morning. I make that 5 and a half days (3 and a half working days). The driver at fault was insured with the Farmers Union.

    You don't have to report it as you weren't driving a motor vehicle at the time. She was. As an injury RTC she should have given over her registration and driver details at the time to anyone having reasonable cause to request them, and her insurance details if she had them. As she hasn't produced any she must report it to the police. There are a string of traffic offences she may have committed that may work in your favour when it comes to applying pressure to pay for the damages. When you do get to speak to her try and record the conversation even covertly as an admission may be forthcoming.

    I was hit by a driver insured by Zurich. They were very quick to sort out the cheque for bike damage. They put the cheque in the post on the same day as I emailed them the damage report from the LBS along with photos and replacement values. Probably more than 3 working days, but only because it took me a few days to get the bike to the LBS, after that it was a day for them to write a quick letter saying X, Y and Z are damaged. And then I sent the email, which they acknowledged and acted on straight away.

    The PI claim took longer, because they wanted to wait to make sure nothing else cropped up after the initial, obvious injuries.

    So, OP: get well soon, wait until you're 100% sure that your injuries are healed before you get onto a PI claim. The doctor who did my assessment (paid by the insurance company) told me to wait as long as I had to to be sure, so I get the correct amount of compensation. In the meantime you should be able to sort out the bike damage. Get pics of damage and injuries and write down a full account of what happened, who was driving, what was said etc
