Loose seal on Fox Floats

Have a set of never ridden Fox Floats (150 mm RL with QR15 - OEM) and when I did a quick "car park test" (up and down on the handlebars) the seal at the top of the lowers came up and all the air was lost.
I'll be trying to pursue warranty with the seller (on-one), but I was wondering what might cause this? Might it be worth putting the seal back in place and storing the fork upside down for a while?
(Am I right in thinking that Mojo won't do warranty work on an OEM fork?)
EDIT: It's the dust wiper that's coming up the stanchion (checked the name of the part in the Fox service manual)
