Sram X7 Derailleur Sticking

I'm getting to breaking point with this :x
My rear derailleur is sticking, it's only 3 months old and has not had much use. It sticks mostly on the big cog and second smallest, when trying to shift to smallest cog.
I have changed all cables, lubed everything. I've even upgraded the shifters to X7.
So I took it off the bike and when I open it by hand it will stick open at full open and also nearly closed (just before it reaches the limit screw) which explains what is happening on the bike.
It's like the spring is nowhere near strong enough, I've cleaned, GT85'ed and lubed the pivots, makes it a bit better but still sticky.
Should I give up and take it back? My worry is the repalcement will be the same.
I only changed to X7 from the X5 as the jockey wheels were worn, should have stuck with X5...

i had a simalar problem with my x.9, just get in contact with who you bought it from, as it seems there are a few sram mechs out there with duff tension springs. they should at the very least send it to fishers outdoor leisure to get it looked at, or hopefully, depending on its condition, just give you a new 10
