If it's advisory then a degree of common sense is needed and ultimately the legality is open to interpretation by the courts. There was a case a couple of years ago where a commuting pedant was successfully prosecuted for cycling slowly in the centre of a lane, causing a tailback of traffic. He had been previously warned by the police that he was causing this and he refused to move over, claiming it was his right, at which point he was arrested for causing a nuisance. The road was a section where there were two lanes in the opposite direction but only one lane in the direction he was travelling, so cars could not overtake legally.0 -
The trouble with common sense is that it's very subjective. For me the example above of the lane hogging cyclist is an easy one decide. But what if he'd been doing the same on the other side of the road where there were 2 lanes? Still not very helpful behaviour but a greyer area I think.
I do my best to be as considerate as possible to ther road users, but I don't really want to give up completely the option to ride 2 abreast even if does soemtimes mean that I have impeded the progress of a motor vehicle in a minor way. And I certainly don't want car drivers treating me as fair game if *they* don't think I'm being reasonable or even if I make a mistake or lose concentration for a few seconds. Which happens; I am human after all. I do wish some car drivers would remember that I'm human too, with all the frailties that implies.0 -

Erm, actually I did read the whole post and I stand by what I say. riding 2 abreast may not be legal in all situations and may leadto you being prosecuted for the offence I outlined.
The rest of your post is talking about civil liability which is a different thing from criminal liabilityWant to know the Spen666 behind the posts?
