PI Question

Ok, I know this is gonna be like, how long is a piece of string BUT, I'm laid up with man flu, looking at new bikes to cheer myself up

Yesterday I found out that in my knee alone, I have a stage 3 MCL Tear and a Stage 1 ACL Tear, caused when the van hit me in July, now, I knew I was suffering but DAMN !!!!!!! They are also doing checks on my back too as that doesn't look ideal.

My question therefore is this (To any PI Sols on here, or anyone who has suffered the same)

Whats the ball park figure for a Stage 3 MCL and Stage 1 ACL that insurance company's normally pay out ?

Should I be looking at a Trek Madone Dura Ace ? Or a Raleigh Pursuit ? :-)

    You need to take advice from a lawyer who has the experience in this field AND has read the full nedical report.

    I qualify as a lawyer, but not on the other grounds. I would expect it to be substantial though. I know what my lawyer advised me my claim was worth. whilst it is nice, it no way makes it worth having an accident

    Thanks Spen, My Solicitor is back in work by the end of the week, so hopefully I'll know more once he reads the report.

    Question is tho, what is substantial ?

    The compensation you receive wrt your bike is decided separately to that of your physical injuries. Compensation for your bike will cover repairs or replacement NOT to get a substantially better one. Of course you can use your total award of damages to buy yourself a Trek Madone if you so wish if you receive that much.

    The amount you may recieve for your injuries will include any residual symptoms or restriction on your activities. There are clear guidelines as to scale of compensation for different types injuries. Obviously the more serious an injury and any substantial residual effects on you the more likely you are to receive an award in the upper part of the bracket for that injury. However it may be you will probably also be unable to ride your bike!!! But you should also be aware that prognosis might not be certain so there will be an element of uncertainty in how much the other side is willing to agree and therefore willing to stump without a fight.

    As Spen says it is better not to have been injured in the first place. The damages you receive is a crude attempt to put you in a position you were prior to the collision. You are not supposed to be compensated so you can subsequently buy a top of the range race bike if you previously owned an Appollo BSO.

    Your solicitor may decide to take instruction from a barrister specialiseing in personal injury cases to get a better idea of how much compensation (quantum) your injuries merit.
