My legal team (BCF's solicitor's) are about to enter into the 'negotiation' phase now we have medical evidence, after almost 2 years, 2 MRI scans and nerve tests......consultants....etc....etc...........
No idea what I should be expecting - £2.99 of a tenner ?
Short term injuries - cuts and bruises to hip shoulder and sore head (helmet impact on road). - All healed as normal.
Medium Term - Left side of upper lumbar region in back - sore and painful for over a year.
Long Term - Sprained Left shoulder A/C Joint - painful for 2 years, has now lead to osteoarthritis in joint - confirmed by independant surgeon that was caused by accident, probably brought on 5 years early (I'm arguing I had no problems before accident) and tendonosis of the upper muscle in the left rotator cuff (failed healing - thickening of tendon). Also have sever clicking and crunching in joint. Likely need surgery in next 5 years. These have been confirmed as permanent.
Then crap to add about stress/ inability to sleep with pain and etc. etc.
So then, what have you had done to you, and the sort of ball park figures paid ?
I've had whiplash in the past and a damaged hip that all healed, that came to £3k (car accident).

I think any attempt to draw an online picture of payouts could be misleading and people should always consult their legal teams first as Spen said (rather abruptly, but he's right)
I did however get £1800 for personal injury for my off 2 years back. That was for cuts, bruises and torn muscles/ligaments:

I got £17k for a sublimated AC joint but then my solicitor was particularly good (wife at the time). Still gives me a bit of gip 15 years on and looks scary when I'm topless
Soft tissue injuries - £500-£1000
Permanent/semi-permanent then another £5k
I'm in no way qualified but its only the injuries that are long-term & severely debilitiating, that qualify for proper compensation. That is because of what needs to be taken into account in your future in terms of what you will need to spend. If you have an existing pre-condition and the accident only brought the onset on by a couple of years, then that won't account for much.
As others have said, then get your solicitors to advise you, that is what they are paid for. If you are using a "Claims Company" then I hope you have a reasonable one. In cases of Personal Injury I would always recommend an APIL registered specialist PI solicitor.1997 Gary Fisher Big Sur

What's all that about? Did you have problems before the accident or not? Just tell the truth for god's sake. As you are no doubt aware, you can get an "independant surgeon" to confirm pretty much anything - as can the insurance company who will likely be assisting the defendant.0 -

No previous problems anywhere - nothing I'm aware of or recorded medically - my solicitor and the third party insurers asked for his view (now't to do with me) - just stated I may have already had it, so am disputing his quoted 'in view of probabilities'..... I.e. his guess with no medical evidence...... So get off your high horse....
My shoulder has been totally screwed in this accident.

No offence meant, your initial post came across the wrong way. Good luck anyway. You should be good for a few grand if permanent injuries involved, ask your solicitor for copies of the relevant bits of the JSB guidelines / examples of similar cases from Kemp & Kemp if you want a better idea of what you might be looking at.0 -
