Only if they know, or should reasonably be expected to know, it's stolen. I.e. they can't legally keep it once it's identified as stolen.
Cheers. I wasn't sure on the intricacies of the law in this respect.Ben

That is just plain wrong. Just because they bought your bike doesn't override the fact that you own it.To err is human, but to make a real balls up takes a super computer.0 -

That only defends them against prosecution for theft, receiving or handling. You bought it in good faith for a dam sight more money than they would have. You should have insisted that the bike be confiscated and then taken it up with a higher officer to retreive it.To err is human, but to make a real balls up takes a super computer.0 -
Take action against ebay for knowinly selling stolen property. Afterall you have informed them it's stolen, and can prove it? i'm no lawyer i'm sure someone here is though?0

Go to trading standards about ebay, try calling watchdog too - you never know. If ebay allow this auction to run after having being informed that there is an official police stolen report on this bike then they surely have some liability in this.0

If it was insured contact the insurance company, who may be helpful in helping you get your goods back as it may be cheaper for them to get your property back than to pay out. Also they have a vested interest in stopping people stealing and flogging on ebay.0

i thought that buying via auction gave the buyer legitimate ownership of the goods, namely that they cannot be prosecuted for receiving stolen goods and the goods cannot be recovered / returned.....?0

How about winning the bid, cash on pick up, turn up with a baseball bat (aluminium ones are best, easy to clean, no dna/evidence left) and break his arms. Take your bike, everyones a winner.
Its what I would do.0
