They should replace the frame, how old is the frame!? I can't believe they told the orginal owner they wont replace it as it's an isolated incident, how does that make any sense at all!?

Lapierre don't sell frames on their own, so my best guess would be the OP purchased a s/h frame.

Plus, it does to me look like the seatpost has been ran too high in the frame

I read my thread and can see how u jumped 2 this conclusion.i bought the frame brand new from a dealer on ebay.im 5'11 and 16 stone.so fairly stocky the frame was an 18" so about right really.the seatpost was in far enough about 3" past the joint.as 4 riding dartmoor with a cracked bike i had just driven 4 an hour and a half to get there and i avoided any big stuff.

iirc Lapierre only sell the Spicy 916 as a frame only and not the technic's?? unless ive got it wrong and it was a complete bike buy not just the frame??

if twas just the frame then maybe - just thginking out loud, the shop owner saw the cheap frames on ebay and thought he'd have some to sell on maybe??/

Yes is was just the frame purchased through ebay, from rollingresistance, and yes he is selling the new engages now, he doesn't seem to be selling the lp's anymore.
Thanx for all the comments, i may try my luck at the nearest dealership, hopefully i will get a more productive answer.

these are the ones i looked at late last year,
    http://cgi.ebay.co.uk/Lapierre-Tecnic-7 ... 2c54396547
the lbs mech said they Could be genuine but! they arnt made in China (made in taiwan i think he said, but defo not china) and are shipped direct from the factory to lapierre and no where else, so how they got them is suspect and they are Very cheap,
he did say they 'could' be genuine but he very much doubted it! was still tempted as is a cheap frame But! came with no warantee etc, and for me was a fair whack of money to take a gamble on! (despite the seller saying 'no fakes' still no garantee!)
was also mentioned that lapierre dont sell that range with a frame only deal,
the owner of the lbs was tempted to get one and have a look at it to see what they are like but decided not to! didnt want to be seen as using 'iffy' products even if it was for his personal fleet!
