An LBS with an attitude like that I'd be inclined to park the bike sideways up their bum! Do you trust them for the future?

Under the "Sale of Goods Act" One of your principal statutory rights is the expectation that the item will be of reasonable quality. This also includes fitness for purpose specified, appearance and finish, freedom from minor blemishes, safety and durability. The failure of the product to meet any one of these criteria is a breach in your statutory rights.

Having paid a deposit has complicated matters if you want to consider withdrawing from the deal but I would argue the LBS has let you down badly and should return it to you, if you want it.

You might want to check out any of the consumer rights sites for info.

    Welcome badwolf.

I wouldn't want a scratch on something i'd paid £10 for let alone 2k. The lbs chap seems to have a bad attitude. Better luck next time & give the bike a good inspection in front of that bloke.

You have every right to refuse it, it's supposed to be perfect when new and perfect you should expect, you are paying the money for goodness sake!

Get your money back and go somewhere else or demand the next frame is perfect! or threaten to tell Trek or the importers, you watch them bend over backwards for you.

With all the faff Trek make of only supplying to 'shops', no dont accept scratched goods.
It will make no odds for its return and replacement - unless the bike is via the grey market of course...where the dealer possibly cannot return goods as easily.

See if you can wangle a discount. Chances are nobody else will pay full price for it either. Worth at least 10% I reckon.

Funk that sh1t. Even if it was a 300 quid bike, it's no acceptable. -Actually even if was a t-shirt for 20 quid, would it be alright if there was a stain on or a rip in it?

Nuts to that says I. If the manufacturer are supplying goods to the shop in less than perfect condition then the shop has some issues with them, not with customers unwilling to accept their soiled goods!

I recently brought a 2nd hand car - after a week I noticed a scratch - I phoned the garage and they sorted the scratch pretty quickly with no charge.

Thats a terrible attitude - a £2k - you have the right to demand it being immaculate - I would have gone elsewhere......

    Please name and shame !
