In collision with a car last night. I've just a few smail cuts and some torn clothes but basically ok. Bike had a bent brake lever but that was easily fixed.
What happened was that I went to pass a stationery car but as I approached it moved to turn right into an adjacent road. Unsure if it indicated or not. Did my best to stop but my left brake lever and arm smashed through the side window. The lady driving was very apologetic and upset. Names and phone numbers exchanged with ladies husband and I went on my way.
Should I just leave things as they are now ?
I'm fine but feel I should have anticipated the possible move by the driver and slowed accordingly. I feel I may have been partially responsible. I'm a BC Silver member so assume I have some insurance cover but would maybe offering an apology end up more trouble then it's worth. If I hear nothing from them should I leave it at that ?

Yes leave it. If you apologise then you're pretty much admitting guilt and they might decide to persue it further, much less hastle to forget it. IMHOwinter beast: http://i497.photobucket.com/albums/rr34 ... uff016.jpg

IMO, Assuming you were using lights if it was dusk or beyond and wearing appropriate clothing (not all black) then I'd say you are not at fault at all.
In my mind, had she checked mirrors and blind spot before pulling away she'd have seen you and acted accordingly (ie: waited for you to pass)
Had you been driving a car and she turned into you, would it be your fault?0 -
Keith, firstly, camn I just check you mean't the followingWhat happened was that I went to pass a stationery car but as I approached , it moved to turn right into an adjacent road.
I'm not being pedantic, but assume you mean the car moved direction, not you.
Do you take it further? That is entirely up to you. I'm sure you will have suffered injuries and damge to your bike. If you are happy with an apology, then that's fine.
Your BC silver mebership covers you for 3rd party claims against you- you probably are required by terms of insurance to notify them of incident even if no one is at this stage indicating a claim.Want to know the Spen666 behind the posts?

Yes spen666 she moved direction. Had the car just moved off straight there would have been no problem as I was in the other lane to pass. I was also well lit. Two front lights and three rear.0

If she moved direction, then its her who should be apologising not you, on the basis of events you have describedWant to know the Spen666 behind the posts?

an apology in the heat of the moment counts for very little and liability won't attach based on this. Report to Police as an RTA involving an injury (no matter how small) as a matter of course and consider your actions over the weekend. Sometimes the hassle and stress are not worth the minor rewards of a claim, especially if there's contributory negligence on your part.0

Sounds like she was completely to blame, she basically pulled out and turned right in your path. She was blatantly not looking where she was going. A similar thing happened to me in Greenwich, I was filtering alongside a queue of traffic which was completely gridlocked and stationary. I was filtering along the right as the left was largely blocked. Suddenly a car waiting in the queue decided without notice/indication of any kind, to do a u turn out of the queue and turn to go back the other way. Luckily he noticed me at the last minute and I simply clipped his wing mirror but it could've been nasty.Do not write below this line. Office use only.0

When you say stationary do you mean parked, i.e. on the left hand side next to the pavement or stopped on the right hand side of the lane about to turn right? If she was parked its her fault if she was positioned to turn right then probably yours.0

I wouldn't say the car was positioned to turn right. On the left I'm sure and I can't recall the indicator going.
I won't be taking it any further I don't think.0 -
Pleased you're OK which is always the main thing, there's not a deal between walking away and being seriously hurt.
You asked what you should do next.
For future reference, always follow these standard instructions in the event of an accident.
1. If you are able to, pick yourself up.
2. Get to a computer.
3. Post brief but inevitably ambiguous details on Cake Stop
4. Wait for spen666 to reply in a condescending and legally imprecise manner
5. Before making a final decision on his advice, check out the reaction from DMClite or Nap D
