Headshok DL80 Failure - again - Has your failed too?

I have a Cannondale F4 (2009) and the Headshok DL80 has just failed for the 2nd time in 4 months.
It has lost all pressure whilst riding. The first time it happened, my LBS fixed it under warrenty. They have said that it will again be a warrenty job.
My question is has this happened to you and if so, what did you do about it? I feel like saying to LBS where I got the bike, that i feel the fork is at fault and not up to the job and I want a different fork fitted. Can I do this? If the fork is failing because it is weak, not faulty, surely I have a case for a replacement?
I would dearly like to hear you experiences of this or be pointed in the direction of information that supports my position.

There is no recall - I would let them fix it again, but I would say a 3rd time was pushing it, and I would ask for a replacement.0
