I think you have to remember that the driver had full intentions of hurting someone. He basically said "I'm going after these guy's" or "I'm going to hurt someone". It's basically attempted murder. He thought about it, conceived a plan, and executed it. Big difference from someone being involved in a traffic "accident"(so to speak). And it's not always the car that's at fault. Some years ago, near here, a cyclist ran a stop sign, T-boned a car, his body went partially through the driver side window and nearly killed the driver. The cyclist hardly got a scratch.
