Rider Down (in Brixton)

Hello,

I'm new so forgive any forum etiquette mistakes. I need some advice...

I was filtering stationary traffic on the right-hand-side down Brixton road (about 15 meters south of Atlantic road). As I came into some space I was clipped from behind by a car, lost control and hit a van head on. My knee went through the indicator light and my head hit the windscreen. I was wearing my helmet but my knee is in a bit of trouble. Won’t be back on a bike until mid-Dec/new year. My bike (Green Bob Jackson Vigorelli, campy parts, insured for £710) is fricked. The forks are completely bent, front wheel totalled and I reckon there could be some damage to the frame. Brixton Police are looking after it for me at the moment.

A friend suggested I come here and ask you guys what to do. My insurance is with CycleGuard but it was the drivers fault, so really he should cover it. I've filled out a witness statement for the police but thats it. My now dwindling fitness (on crutches) is annoying but it’s the bike that pisses me off.

Any help would be hugely appreciated.

    Sorry to hear about your 'off'.

    Firstly, take yourself to a doctor or A+E to get your knee and other injuries checked out and noted (including the reason for them).

    Oooh, unluckies!!! Glad you're mostly OK. Get yerself to a lawyer - as per Spen's recommendations. Bikeline - Alyson France IMO. Keep a diary of everything that is accident related - pains, pictures, stuff you had to pay for because of the accident (travel, taxis, lost time at work because of sorting things out, etc.). Keep all receipts, and don't be too quick to accept a settlement.

  • Cheers for the replies, I forgot to mention that I spent 4 days in hospital and had a major operation to put my knee back together.

    Maybe I'll get in touch with one of those lawyers..

    No maybe about it0- you have a serious claim there- 4 days in hospital!

    I suspect you bike insurance will make a claim against the other driver on your behalf to recover the cost.

    You'll need to make any personal injury claim through a solicitor unless you have legal aid as part of that cycle insurance (or sometimes household insurance), although if you have personal injury cover on the bike insurance you could claim through that.

    Try and avoid using a no win no fee unless you have to, they ultimatley push up all our insurance costs as they are more costly to the payee of any settlement.
