Sorry to hear about the accident, and no doubt all the worry and stress it's causing you! I had an accident in May 08, wasn't insured, hadn't joined CTC...Anyhow, won't go into the dull and boring details (see http://www.bikeradar.com/road/forums/vi ... t=12569850) but i contacted cycle claims =
http://www.cycle-claims.co.uk/index.php who advised me i had a strong case to claim for personal injuries and for my bike being written off :( They then sorted a solicitor and managed to claim against the driver - though the final verdict it was 50/50 - could've gone to court but i couldn't afford it and would've ended up being stumped with all the legal fees if i'd lost the case. Could be a good starting point for advice at least? Also - had the guarantee of my home insurance - worth checking. Also, if you're part of any unions through work, they could also offer some kind of legal advice. Hope it all goes well..i was really worried when it happened, as the woman was really apologetic at the scene, but a complete cowbag afterwards...good luck!

Hi mev. Thanks for the reply. I read your thread and I'm glad it's been sorted for you in the end although I think the other party got a bit of a result with a 50/50 outcome. It should all have been put down to her as far as I'm concerned.

The problem in my case though is that I couldn't even hope to get a 50/50 and I'd end up with a hefty legal bill to pay as well as whatever the insurance company have paid out for repairs. I can't see how I've any defence really as I rode into the back of her - simple as that. Unless I lied and said she reversed or something, but I couldn't do that. And if went to court I could never lie under oath (I'm not sure if you take the oath in civil cases mind).

All I can do now is hope they don't take the wee wee with what they are claiming for as I can ill afford a hefty repair bill. However, I have now made sure I'm completely covered in the event something like this happens again. I certainly learn the hard way.

I've just watched Panorama tonight. Really wish I hadn't though as it was about people claiming for personal injury and PTSD.
