Can anyone tell me why my back wheel has started to rub on my break pad when going up hill out of my seat?

I have had a look at the wheel and it apears to be okay.

Easton Vista SL Wheels, less than a month, (just over 500 miles)

Out of true, brakes somehow moved, wheel slipped in the dropouts, brake pads too close to the rim and you've just noticed that they rub when out of the saddle, wheel
not centered when it was mounted in the dropouts.
Not sure what you mean by "had a look at the wheel". A "look" to me is on the truing stand.

Spokes not tensioned correctly would be my guess. Could be totally wrong though. :?

Dead on m8, Wheel out of true, just a touch, now then what would cause that in a wheel that has only done just over 500 miles :?:

The short answer is the spokes cause that. Not all that unusual in a new set of wheels.
They sometimes(not always) need a bit of touching up in the first miles. If you got them
at a shop they should be happy to give you a quick fix. If mail order, well, they will do it
and probably charge you. For good reason, bike shops don't really like to see you walk in
with mail order things, but they will do it(for the money).
On a slightly different take, it's always a good idea to get your "stuff" at a bike shop, particularly if you don't do your own maintenance, as then they are always glad to see you.

Thanks for that, I now feel a lot better, (long story) and no rattle, what would that indicate :?:
