Between offices...

Does anyone else cycle cbetween their company offices - I do this regularly for meetings....but apparently, there may be issues with it under the new corporate manslaughter laws - anyone know anything?

I am insured under the CTC scheme....which I personally think my company should pay for as I only got insurance to cover me between offices - but thats my problem.

  • Corporate manslaughter act wont come into it. You're work isn't forcing you to cycle, providing the bike, dictating the route etc.

    Not personally, but in a previous job a colleague managed to get a mileage allowance for it.

    If the insurance company raises premiums due to it, and the lawyers can't specifically rule out prosecution, (and since it's the courts who decide the law, they probably won't be able to until a cyclists is cleared in court) then you might just find management will ban it anyway to be on the safe side.

    They won't say it's to be on the safe side, they will say it's banned due to the corporate manslaughter act or PC gone mad or offending terrorists or some other excuse, of course :)

    Corporate manslaughter seems to have nothing to do with you cycling to the sites- assuming it is your choice.

    If your employer won't pay you a mileage allowance, you can claim it as a tax rebate/ offset it against your tax. You need to complete a tax return. There is a set rate per mile that Revenue allow.

    It only applies to journies between work sites, not to journey from home to permanent place of work

    You should get mileage for it - 20p or 24p per mile, I forget which. Don't forget to apply!

    Chaars all - seems a strange one as I don't know and have never given a crap abou it. Just get on bike and go!

    My new boss just pointed out that I would need some kind of business insurance for travelling to other sites otherwise my company would be liable for any accident as I am on business. I have CTC insurance anyway (I am hoping that my employer will pay it now though as they are offering to pay the extra for people to business insure private cars!).

    I understand that businesses are worried about drivers causing death when they're on their work mobile. Following the arguement that employers expects their employees to take stressful phone calls whilst driving (even on a hands-free kit) may cause accidentsthen, ultimately, the big bosses could face a corporate manslaughter charge.

    But...a voluntary decision to cycle between offices doesn't seem to me to be anything for the big bosses to be worried about. And, you wouldn't have insurance if you were walking or public-transporting between offices so what's the difference?
  • The Corporate Manslaughter act has no relevance here unless you have specific guidelines from your senior management advising on suitable methods of transportation between offices.

    Unless this is the case, senior management cannot be held responsible. As was said, if you were walking between the offices and were ran down, that wouldn't be the company's fault. If you were driving and another car hot you, that wouldn't be the company's fault.

    Think your employer needs to talk to their insurers. I used to get paid extra to cover my insurance on my car covering me for work use; not sure how this applies to bikes - your employer paying your mileage could be a contribution to your CTC cover, and therefore cover them for liability.

    Any lawyers out there?

    No but I work in insurance and I've never seen an insurer ask for details on how employees travel between places of work.

    Employers liability is calculated based on number of employees, salaries, claims experience and the risk posed by the type of work undertaken.

    Just a thought, is the bike a "bike2work" one if so they are actively encouraging you already, so I can't see that they can say it's alright to ride to work, but not between sites for work.
