Flipping hell this is definately not my year

There i am riding along minding my own business 3:05 pm im riding on the way to an appointment, on the same stretch of road as the one i got hit on the last time , see link( http://www.roadcyclinguk.com/forum/foru ... 88/V/5/SP/ )

but this time ive got to turn right to go up Bowerdean Rd at the roundabout, i follow good road form check behind to go into correct lane to turn right no prob thus far, turning right on roundabout good so far, silver car stops at junction to give me right of way, ive just passed silver car when some numpty in a red Nissan Micra ( reg ill take on advisement)so here follows Moron204 Unsafe Jerk M***********r )undertakes silver car by the pheasant pub ( many thanks to the occupants for your assistance and help ) and wipes me out , not more than a hundred yrds from the incident last easter.

Slightly different result this time so whomever you are ( unlikely to read this) Ive got your number plate,

ive got your Face, And ive got 4 witnesses so to put it in short you are so screwed you really should have just stopped and not jumped the red light.

because you didnt you are now so SCREWED

it remains for me to thank the four people that immediately stopped to see if i was ok and thank you for being my witnesses, but most of all thank you to the lady in the people carrier who tried to chase the idiot down , God bless you all you have helped restore my faith in human nature.

Im sure that you will all be glad to know that i walked away with minor contusions mild bruising and minor shock, which is somewhat amazing as i know i ended up a good twenty to thirty ft from point of impact

thank goodness i dont break , and i sure as hell dont give up.

So Mr Micra man consider yourself pursued , i dont forget , i dont forgive , and i WILL get even.

So to all my 2 (or 3) wheeled brethren out there especially in the wycombe area go careful there is still no shortage of idiots on the road.

  • Sorry to hear about that, hope you recover. Get yourself to a doctor ASAP though, muscular or whiplash-type injuries might not appear until well after the event. Not that you don't know this, but when you go after him you can and should royally do him for all you can squeeze out of his insurance company, but you have to have medical evidence for injury claims.

    I'm not a huge fan of the compensation culture, but some people really do deserve what's coming to them.

  • went to police paramedic checked me then to hospital, and most definately going to docs tommorrow cos im sure im gonna hurt like Hell in the morning.

  • Hmmm might want to remove that number plate, dunno where the law stands there :?

    Anyhoo i second lit's comment, when at the doc really play up the whp-lash and try and get him to sign you off work( whiplash feels like really stiff/pulled muscles btw :? )
    we don't want to become America but these tw@ts really put the willies up a lot of us so you'll be doing the cycle forum a justice.

  • hiya stefano thanks for your support, i get what youre saying about number plate not sure if the forum objects ive no issue removing it but hell , hit and run , jumping red lights failure to report accident the guys got no rights as far as im concerned , and there may be local cyclist who need to keep an eye out as he automatically poses a danger to them, dont you think,and as for playing up the injuries i wouldnt cosider doing such a thing :wink: much eh

    Number plates are commonly in posts around here I wouldnt worry about it.

    Just hope the car is properly registered and not on stolen plates :(.

    I'd get rid of the numberplate anyway - it can't hurt and in the event that the defence found out you'd been posting it in public it could be considered prejudicial?

    Nah, I don't reckon it's a problem and besides it is for others safety in that area, possibly also so that people can spot the car and report the whereabouts to the Police as there should be a warrant out for the driver's arrest by now.

    Caretaker42, well done for your chin up approach mate, it must be a huge shock for something like that to happen but you've got true grit!

    As someone who was driving two different cars, both hit from behind in exactly the same spot two weeks apart, you have my sympathy, glad you are (relatively) OK.

    Re-pursuing the perps: go get 'em, get yourself and ambulance chasing lawyer - my mate was totalled on his bike and sued the backside off the driver. He was hospitalised for (I think) 4 broken ribs. One month of morphine later he was on the mend.

    It's just a hill. Get over it.

    No problem with the number plate IMHO. It would only be a possible wrong if you were making statements that were untrue and/or not in the public interest.

    So criminal prosecution of the driver has just been completed.

    With what was he charged and what was he convicted of?
    What was his penalty as you say he was found guilty but of what?

    The civil claim will now start. A finding of guilt under the criminal law is prima facie evidence of negligence under the civil law as the standard of proof is higher.

    It would be very unlikely he would succeed in a claim of whiplash against you but he can try, they all do! Make sure you have got a good solicitor who specialises in cycling and PI claims. As he's been found guilty of the criminal offence liability will not be an issue in your civil claim plus you have 4 witlesses. Crucially was the driver insured? If so your are onto a winner. Obviously it would have been better not to have been knocked off in the first place but this could be lucrative for you. How has your recovery been? 4 broken ribs seems like you suffered substantial injury and pain and suffering. Any loss of amenity or have your injuries permanently limited the activities you can now do in any way? Prognosis?
