Visia Seat Post / Wiggle

I bought an ITM Visia seat post from Wiggle back in the spring. It got it knowing it was overweight carbon wrap because (a) it was cheap (b) it fitted my seat tube (31.6) and (c) it looked nice (IMO).
I fitted it to my bike, scratching the Carbon wrap necessarily in the process. Didnt ride it for a few weeks.
After a few rides I concluded the product - or at least the specific one I had bought - was not fit for the purpose because the seat kept slipping up or down when i went over bumps in the road. Here is the description on my return;
"Seat slips up and down out of position when going over small bumps on the road. Have tried 2 separate seats, same problem. Have tightened to the point that the threads are at risk of stripping / or allen bolts rounding out / or seat rails being damaged. No improvement. Can make seat slip by forcing it with hands too."
I had the seat post in my possession for about 6 weeks. Wiggle have returned in to ITM for repair if possible.
I have no issue with Wiggle in respect of the above, however I am kind of left in the lurch; I had to buy another seat post in the mean time (Pro PLT very nice too) so even if the Visia is returned repaired I have no use for it and probably would not be able to sell it on because it will be scratched up to the point on the post where i fitted it in my seat tube.
Does anyone know what my rights are? Is this one to put down to experience?
